A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM MAKING CERTAIN FINDINGS AND DETER-
MINATIONS WITH RESPECT TO AN AGREEMENT WITH
ULTRASYSTEMS, INC. RELATING TO DEVELOPMENT
OF A PROGRAM FOR THE CONTINUOUS EVALUATION
OF GROWTH AND ITS IMPACT AS A BASIS FOR A DE-
SIRED LAND USE PLAN FOR THE CITY OF ANAHEIM
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE NECESSARY AGREEMENT WITH ULTRA
SYSTEMS, INC.
WHEREAS, the City of Anaheim desires to provide for
a planning study contributing to improved executive planning,
decision making and management capability; to the encouragement
of community planning and management as a continuous process; and
to the solution of problems, realization of opportunities and the
formulation and implementation of policies related to community
development and growth; and
WHEREAS, the City Council of the City of Anaheim ap-
proved Resolution No. 77R -353 on May 17, 1977, requesting the
California Office of Planning and Research to provide planning
assistance under the authority of the Government Code of the State
of California, with such financial assistance as may be provided
by the U.S. Department of Housing and Urban Development, under the
authority of Section 701 of the Housing Act of 1954, as amended;
and
WHEREAS, competitive bidding was held by the County of
Orange to procure consultant support for the development of a com-
puterized methodology to compute the various land development,
economic, and environmental impacts and, as a result of said bid-
ding, Ultrasystems, Inc. (hereinafter "Ultrasystems was awarded
a contract for said services on September 8, 1975, and, subse-
quently, Ultrasystems was awarded a sole source contract on August
3, 1976, by the Orange County Board of Supervisors due to its
satisfactory past performance, expertise in the related work, and
knowledge of the present models to be used; and
WHEREAS, the herein specified third year of HUD 701
grant funding constitutes an extension of the previous two years
of funded research and the data base of existing land use informa-
tion and of proposed land uses as reflected by the recently adopted
City of Anaheim General Plan for the Santa Ana Canyon Area are al-
ready stored in the Control Data Corporation Model 6600 Computer
at the Ultrasystems facility in Irvine and the corresponding com-
puter software developed exclusively by Ultrasystems is already
on -line and available for immediate use at this facility; and
WHEREAS, the City of Anaheim desires to use Ultrasystems'
the current contractor, Ultrasystems, which has provided the ne-
cessary technical assistance for the study to date due to the ex-
perimental and unique nature of the computerized methodology; and
WHEREAS, the City of Anaheim desires to use Ultrasystems'
services as near as possible to the beginning of the grant period
on July 1, 1977, and Ultrasystems' staff is immediately available
by virtue of its present on -going efforts for the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim as follows:
1. The City Council of the City of Anaheim finds and deter-
mines that it is necessary to enter into an agreement for technical
assistance for the development of a program and methodology for the
continuous evaluation of growth and its impact as a basis for a de-
sired land use plan for the City of Anaheim.
2. The City Council of the City of Anaheim finds and deter-
mines as follows:
(a) Specifications for the technical assistance and
computer services to be supplied to the City as above described
would merely be descriptive of the existing computer model as de-
veloped by Ultrasystems, Inc.
(b) Advertisement for competitive bids for furnishing
said technical assistance and computer services based upon such
specifications would work an incongruity, would not affect the
final result, would produce no advantage, and would be otherwise
undesirable.
(c) Based upon these facts and findings, the City Council
proposes to enter into an agreement with Ultrasystems, Inc. for the
furnishing of said technical assistance and computer services.
BE IT FURTHER RESOLVED that, subject to the receipt of
the requested grant funds, the Mayor and City Clerk be, and they
are hereby, authorized and empowered to execute in the name of
the City of Anaheim all necessary agreements and amendments
thereto necessary to implement and carry out the purposes de-
scribed in this resolution in accordance with the terms and con-
ditions specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 5th day of July 1977.
