A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ADJUSTING DEVELOPMENT FEES
ESTABLISHED PURSUANT TO CHAPTER 17.30 OF
THE ANAHEIM MUNICIPAL CODE (INTERIM
DEVELOPMENT FEES - ANAHEIM STADIUM
BUSINESS CENTER).
WHEREAS, Chapter 17.30 of the Anaheim Municipal Code
established certain fees imposed upon development within the
Anaheim Stadium Business Center; and
WHEREAS, the City Council hereby determines that the
purpose of the fees is to provide Anaheim Stadium Business Center
infrastructure, that the fees will be used to finance street
improvements and fire services, and that there is a relationship
between types of development in the Anaheim Stadium Business
Center and an increased need for street improvements and fire
service in the area; and
WHEREAS, Section 17.50.060 of Chapter 17.30 authorizes the
City Council of the City of Anaheim to periodically adjust the
amounts of the fees in accordance with the construction cost index
for construction costs in the Los Angeles area as published in the
Engineering News-Records Construction Cost Index ("ENR-CCI"); and
WHEREAS, the City Council hereby finds that since adoption
of Chapter 17.30 in 1985, the ENR-CCI has risen 2.9% in 1989, and
based thereon the City Council desires to increase the Chapter
17.50 fees accordingly.
NOW, THEREFORE, be it resolved by the City Council of the
City of Anaheim as follows:
1. The fees set forth in the various Subsections of Section
17.30.020 of Chapter 17.30 of the Anaheim Municipal Code
shall, upon their effective date as set forth below, be as
follows:
17.30.020a ................ $4.48/sq. ft.
17.30.020b ................ $1.14/sq. ft.
17.30.020c ................ $2.27/sq. ft.
2. The fees established herein shall become effective on the
sixtieth (60th) day following the date of this Resolution,
and thereafter supercede previously adopted applicable
fees.
3. The establishment of these fees is exempt from the
provisions of the California Environmental Quality Act
pursuant to Section 21080(b)(8) of the California Public
Resources Code.
4. The City Council hereby declares that should any one (1)
or more of the fees established herein, or any portion of
this Resolution be declared to be invalid for any reason,
it is the intent of the City Council that it would have
adopted all other fees and portions of this Resolution
independent of the elimination herefrom of any such fee or
such portion of this Resolution as may be declared invalid.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 19th day of June , 1990.
