A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING A SPECIAL PERMIT TO
MOVE FOUR (4) RESIDENTIAL STRUCTURES FROM
1207 WEST CENTER STREET, 1621 WEST LINCOLN
AVENUE AND 125 WEST ELM STREET TO
REDEVELOPMENT AGENCY -OWNED LAND LOCATED
AT 120 WEST WATER STREET, 129 AND 131 WEST
STUECKLE AVENUE AND ON 1225 WEST CENTER
STREET IN THE CITY OF ANAHEIM.
WHEREAS, the Anaheim Redevelopment Agency (the "Agency ") intends to
relocate and restore four (4) residential structures (collectively, the "Structures "); one of the
Structures is currently located at 1207 West Center Street, another is located at 1621 West
Lincoln Avenue and two more are located at 125 West Elm Street in the City of Anaheim; and
WHEREAS, the Structures are currently deteriorated and damaged with
substandard mechanical equipment; and
WHEREAS, in accordance with Chapter 15.32 of the Anaheim Municipal Code,
the Agency has filed a written application (the "Application ") with the City of Anaheim for a
special permit to move the Structures from their current location to Agency -owned land generally
located at 120 West Water Street, 129 and 131 West Stueckle Avenue and 1225 West Center
Street in the City of Anaheim (the "Relocation Properties "); and
WHEREAS, the Application was set for a public hearing on November 13, 2006
at 5:30 P. M. (the "Public Hearing ") and notice of the time and place fixed for the Public Hearing
was given at least ten (10) days prior to the date fixed for the Public Hearing by mail to all
persons owning property within a one thousand (1,000) foot radius of the Relocation Properties
(as the names of such owners appeared on the last available tax assessment roll); and
WHEREAS, after duly conducting the Public Hearing upon the date set therefor
and after duly considering the Application for a Special Permit, together with all evidence and
reports submitted in connection with the Public Hearing, the City Council does find that such
permit should be granted for the following reasons:
upon relocation and restoration, the Structures will be comparable in value, size,
quality, design and appearance to the structures located in the neighborhoods of
the Relocation Properties;
upon relocation and restoration, the Structures will not be detrimental to, nor
diminish the value of, property near the Relocation Properties;
upon relocation and restoration, the Structures will conform to the provisions of
Title 18 of the Anaheim Municipal Code that are applicable to the Relocation
Properties; and
4. the relocation and restoration of the Structures has been determined to be exempt
from the provisions of the California Environmental Quality Act ( "CEQA ") in
accordance with Section 15301(d) of the Guidelines for CEQA and has been
determined not to have a significant effect on the environment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. Special Permit Granted. The Application to move the four (4) Structures to the
Relocation Properties as set forth above is hereby granted subject to compliance with all
applicable provisions of Title 15 and 18 of the Anaheim Municipal Code.
THE FOREGOING RESOLUTION IS PASSED, APPROVED AND ADOPTED BY THE
CITY COUNCIL OF THE CITY OF ANAHEIM THIS THIRTEENTH (13TH) DAY OF
NOVEMBER, 2006, BY THE FOLLOWING ROLL -CALL VOTE:
