A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE APPLICATION FOR FUNDS
UNDER THE ROBERTI- Z'BERG.URBAN OPEN -SPACE AND
RECREATION PROGRAM ACT (S.B. 174) FOR PHASE II
DEVELOPMENT OF PERALTA CANYON PARK AND AUTHORIZING
THE CITY MANAGER TO EXECUTE SAID APPLICATION ON
BEHALF OF THE CITY OF ANAHEIM.
WHEREAS, the State of California under the Roberti
Z'Berg Urban Open-Space Recreation Program Act (S.B. 174) has
authorized the establishment of a state fund for partial funding
of open -space and recreational area development by local agencies;
and
WHEREAS, the City of Anaheim is currently in the process
of completing development of Phase I of Peralta Canyon Park in the
City of Anaheim; and
WHEREAS, the City is eligible to apply for the funding
of Phase II of the Peralta Canyon Park development under the
provisions of the Roberti- Z'Berg Urban Open Space Recreation
Program Act (hereinafter "Act"); and
WHEREAS, the application for, and approval of, said
funding will provide the necessary financial resources to enable
the City to initiate Phase II of the Peralta Canyon Park develop-
ment project without a major interruption in the construction
schedule; and
WHEREAS, in compliance with the guidelines established
by the State for funding under said Act, the City of Anaheim will
be required to fund twenty -five percent (257) of the project which
funds are available and will be contributed to said project by the
City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby approve the filing of an applica-
tion under the Roberti-Z'Berg Urban Open-Space and Recre ti n
Program Act for the funding Of Phase 11 of development of the
Peralta Canyon Park within the City of Anaheim.
BE IT FURTHER RESOLVED, that the City Council of the
City of Anaheim certifies that the City understands the assurances
and requirements of the application and certifies that it will
comply with the regulations, policies, guidelines, and requirements
as they relate to the application.
BE IT FURTHER RESOLVED that the City Council of the
City of Anaheim certifies that the City has funds froi the
following sources in lieu fees and developers' participation,
and can fund its proportionate share of the cost of said project.
BE IT FURTHER RESOLVED that the City Council of the
City of Anaheim certifies that the City meets the planning re-
quirements and that the project is compatible with the land use
plans of those jurisdictions immediately surrounding the project.
BE IT FURTHER RESOLVED that the City Manager of the
City of Anaheim be, and he is hereby, authorized as agent of the
City to conduct all negotiations, execute and submit all documents,
including but not limited to applications, agreements, amendments,
billing statements, and so on which may be necessary for the com-
pletion of the aforementioned project.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of May 1977.
