A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DETERMINING THAT CERTAIN PROPERTY
IS UNUSABLE FOR CERTAIN PURPOSES; ACCEPTING
AN OFFER TO PURCHASE SAID PROPERTY; AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A DEED THERETO.
WHEREAS, the City of Anaheim is the owner of certain
real property described as follows:
That portion of altered Orchard Drive (now
known as Kellogg Drive) as relinquished to
said City of Anaheim, by the California
Highway Commission, a certified copy of the
resolutions thereof having been recorded
July 9, 1965 in Book 7588, page 303,
Official Records, said portions being de-
scribed as follows:
That portion of Lot 5 in Block 24 of Yorba
Linda Tract, as shown on a map recorded in
Book 5, pages 17 and 18, Miscellaneous Maps,
records of said Orange County, described as
follows:
Beginning at the westerly terminus of that
certain course described as S 72° 14' 13"
W, 29.66 feet in the deed to the State of
California recorded in Book 6921, page 635,
Official Records; thence along the two
following courses described in said Deed,
S 14° 53' 03" W, 132.44 feet and S 4° 17'
30" W, 96.79 feet to a point in a curve
concave easterly and having a radius of
345.00 feet, this latter point being in
the east line of said Orchard Drive, 60.00
feet wide; thence from a tangent bearing
N 11° 19' 20" W northerly along said curve
through an angle of 32° 10' 03" an arc dis-
tance of 193.69 feet; thence tangent N 20°
50' 43" E, 14.57 feet to a tangent curve
concave southeasterly and having a radius
of 320.00 feet; thence Northeasterly along
last said curve through an angle of 5° 07'
50" an arc distance of 28.65 feet; thence
S 56° 18' 09" E, 10.61 feet to the point of
beginning.
Excepting therefrom that portion described in
Parcel No. 105.1 in the Deed to the County of
Orange recorded November 9, 1965 in Book 7734
page 226, Official Records (hereinafter
Property); and
WHEREAS, Property is not needed for present or
prospective City purposes; and
WHEREAS, Property is unusable for park and recreation,
open space, or housing purposes due to its size, shape, slope,
elevation, and location; and
WHEREAS, City has received an offer to purchase
Property, said offer contained in a letter from Ta Development
Corporation, Inc., dated August 18, 1977; and
WHEREAS, it is in the best interest of the City of
Anaheim to accept said offer and to sell Property.
NOW THEREFORE BE IT RESOLVED that the City of Anaheim
does hereby accept the offer of Ta Development Corporation, Inc.
to purchase Property.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are authorized to execute a deed to Property upon receipt of
the purchase price by the City.
BE IT FURTHER RESOLVED that the City Clerk be, and
she is hereby directed to transmit the executed deed to the
Ta Development Corporation, Inc.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 18th day of
October 1977.
