A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING, IN PART, VARIANCE NO.
2960.
WHEREAS, after a request for variance by SENT-PAC
CORPORATION, owner; BILL MC CULLOCH, agent, was received, a public
hearing before the Planning Commission of the City of Anaheim was
held upon due and proper notice, a result of which Variance No.
2960 was granted covering the following described property:
PARCEL 1 The East 165 feet of the West 495 feet
of the East half of the Southwest quarter of the
Southwest auarter of Section 12, Township 4 South,
Range 11 West, in the Rancho Los Coyotes, as shown
on a mao recorded in Book 51, page 11 o .liscellan-
eous Maps, records of Orange County, California,
said East half of the Southwest quarter of the
Southwest quarter of said Section 12 being described
as commencing at a point in the South line of said
Section, North 39° 41' East 662.75 feet from the
Southwest corner thereof; thence North 0° 13' West
1328.09 feet to a point, thence North 89° 41' 10"
East 663.44 feet to a point; thence South 0° 14'
45" East 1320.05 feet to a point; thence South 09°
41' West 662.75 feet to the place of beginning.
Excepting therefrom the South 40 feet.
PARCEL 2 That portion of the East half of the
Southwest quarter of the Southwest quarter of Sec-
tion 12, Township 4 South, Range 11 West, in the
Rancho Los Coyotes, as shown on a map recorded in
Book 51, page 11 of Miscellaneous Maps, records of
Orange County, California, described as beginning
at a point of the South line of said Section, North
39° 41' East 662.75 feet froni the Southwest corner
thereof; thence North 0° 13' East 1320.09 feat to
a point; thence North 89° 41' 10" East 663.44 feet
to a point; thence South 00 14' 45" East 1323.05
feet to a point; thence Soutc 09° 41' West 662.75
feet to the Place of beginning. Except the Net
495.00 feet thereof. Also except the North 726.00
feet thereof. Also excepting therefrom the North
50 feet of the South 155 feet of the East 28 feet.
Also excepting therefrom the South 40 feet.
PARCEL 3 The North 726.00 feet of that portion of
the East half of the Southwest quarter of the South-
west quarter of Section 12, Township 4 South, Range
11 West, in the Rancho Los Coyotes, as shown on a
map recorded in Book 51, page 11 of :1iscellaneous
Maps, records of Orange County, California, described
as commencing at a point in the South line of said
Section, North 89° 41' East 662.75 feet from the
Southwest corner thereof; thence North 0° 13' West
1328.09 feet to a point; thence North 89° 41' 10"
East 663.44 feet to a point; thence South 0° 14'
45" East 1328.05 feet to a point; thence South 89°
41' West 662.75 feet to the place of beginning.
Excepting therefrom the West 495 feet.
PARCEL 4 An undivided 1/2 interest in the North
50 feet of the South 155 feet of the East 28 feet
of the East half of the Southwest quarter of the
Southwest quarter of Section 12, Township 4 South,
Range 11 West, in the Rancho Los Coyotes, as shown
on a map recorded in book 51, page 11 of Miscellan-
eous Maps, in the office of the County Recorder of
said County, together with a like interest in the
water wells, pumping plant and equipment situated
thereon. Also excepting all subsurface water
rights, as dedicated to the City of Huntington
Beach on the map of said tract; and
WHEREAS, thereafter, within the time prescribed by law, an
interested party or the City Council on its own motion caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council does hereby make the following findings:
1. That there are special circumstances applicable to the
property, including size, shape, topography, location or surround-
ings, which do not apply to other property under identical zoning
classification in the vicinity.
2. That, because of special circumstances shown in (1)
above, strict application of the zoning code deprives the property
of privileges enjoyed by other property under identical zoning
classification in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim, that a conditional zoning variance be, and
the same is hereby granted tier:aitting the construction of a 190
unit apartment compl on the Drop arty hereinbefore described
with waivers of the following sections of the Anaheim Municipal
Code:
SECTION 18.34.062.050 i4aximum building height.
(One story permitted within
150 feet of RS- A- 43,000 and
RS -7200 Zones; two and three
stories proposed)
SECTIO 13.34.063.012
Minim ia structural setback.
(15 feet required; 9 1/2
feet proposed)
That said variance be granted subject to the following conditions:
1. That this Variance is granted subject to the coiapletion
of Reclassification No. 77-78-7, now pending.
2. That the owner of subject property shall submit a letter
requesting termination O.L. Conditional Use Permit No. 1643.
3. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit Nos. 1 through 3, as corrected by the
petitioner.
4. That Condition Nos. 1 and 2, above mentioned, shall be
complied with prior to the commencement of the activity authorized
under this resolution, or prior to the time that the building per-
mit is issued, or within a period of one year from date hereof,
whichever occurs first, or such further time as the Planning Com-
mission may grant.
5. That Condition No. 3, above mentioned, shall be complied
with prior to final building and zoning inspections.
BE IT FURTHER RESOLVED that the City Council hereby re-
serves the right to revoke such variance permit for good cause or
failure of said owner, its successors or assigns to comply with
the Anaheim Municipal Code and regulations and the conditions
herein. Said variance is granted for the term prescribed by the
Anaheim Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 13th day of September,
1977.
