RESOLUTION NO. 77R -616
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceedings
No. 77 -78 -7 to consider an amendment to Title 18 of the
Anaheim Municipal Code relating to zoning, and to consider a
change in the boundaries of the zone or zones hereinafter men-
tioned and described and, at said hearing, did receive evidence
and reports from persons interested therein and from its staff;
and
WHEREAS, within a period of forty (40) days following
said hearing, the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing and approved the proposed amendment;
and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports, and did consider the
same; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should he
adopted and that the property hereinafter described should be
excluded from the zone or zones in which it is now situated and
incorporated in the zone or zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following de-
scribed property, situated in the City of Anaheim, County of
Orange, State of California, to wit:
PARCEL 1 The East 165 feet of the West 495 feet
of the East half of the Southwest quarter of the
Southwest quarter of Section 12, Township 4 South,
Range 11 West, in the Rancho Los Coyotes, as shown
on a map recorded in Book 51, page 11 of Miscellan-
eous Maps, records of Orange County, California,

said East half of the Southwest quarter of the
Southwest quarter of said Section 12 being described
as commencing at a point in the South line of said
Section, North 89° 41' East 662.75 feet Troia the
Southwest corner thaheof; thence North 0° 13' West
1328.09 feet to a Point, thence North 09° 41' 10"
East 663.44 feet to a point; thence South 0° 14'
45" East 1320.05 feet to a Point; thence South 09
41' West 662.75 feat to the place of beginning.
Excepting therefrom the South 40 feet.
PARCEL 2 That portion of the East half of the
Southwest quarter of the Southwest quarter of Sec-
tion 12, TownshiP 4 South, Range 11 West, in the
Rancho Los Coyotes, as shown on a map recorded in
Book 51, page 11 of Miscellaneous Maps, records of
Orange County, California, described as beginning
at a point of the South line of said. Section, North
89° 41' East 6E2.75 feet from the Southwest corner
thereof; thence North 0° 13' East 1323.09 feet to
a Point; thence North 29° 41' 10" East 663. feet
to a point; thence South 0° 14' 45" East 1322.05
feet to a point; thence South 39° 41' West 662.75
feet to the place of beginning. Except the West
495.00 feet thereof. Also except the North 726.00
feet thereof. Also excepting therefrom the North
50 feet of the South 155 feat of the East 23 feet.
Also excePtina therefrom the South 40 feet.
PAR= 3 The North 726.00 feet of that portion of
the East half of the Southwest quarter of the South-
west quarter of Section 12, Township 4 South, Range
11 West, in the Rancho Los Coyotes, as shown on a
map recorded in Book 51, page 11 of Miscellaneous
claps, records of Orange County, California, described
as commencing at a point in the South line of said
Section, North 89° 41' East 662.75 feet from the
Southwest corner thereof; thence North 0° 13' West
1328.09 feet to a point; thence North 89 41' 10"
East 663.44 feet to a point; thence South 0° 14'
45" East 1320.05 feet to a point; thence South 89°
41' West 662.75 feet to the place of beginning.
Excepting therefrom the West 435 feet.
PARCEL 4 An undivided 1/2 interest in the North
50 feet of the South 155 feet of the East 23 feet
of the East half of the Southwest quarter of the
Southwest quarter of Section 12, Township 4 South,
Range 11 West, in the Rancho Los Coyotes, as shown
on a map recorded in book 51, pace 11 of .1iscellan-
eous Maps, in the office of the County Recorder of
said County, together with a like interest in the
water wells, pumping plant and equipi.ent situated
thereon. Also exceptinc all s water
rights, as dedicated to the City of iluntington
3each on the i,ap of sai2 tract,
be excluded from "RS-A-43,000" RESIDENT=VAGRICULTURAL ZONE and
incorporated in the "an-12o0 RESIDE=IAL, :1ULTIPL:1-FA=LY ZOLM,
subject to the following conditions:
1. That the owner of suhject property shall deed to the
City of Anaheim a fifteen (15) foot radius property line return
at the northwest corner of Lincoln Avenue and Bel Air Street.
2. That all engineering requirements of the City of Ananeim
along Lincoln Avenue, including oreparation of improvement plans
and installation of all improvements such as curbs and gutters,
sidewalks, street grading and oaving, drainage facilities or other
appurtenant work, shall be complied with as required by the City
Engineer and in accordance with standard plans and specifications
on file in the Office of the City Engineer; that street lighting
facilities along Lincoln Avenue and Bel Air Street shall be in-
stalled as required by the Director of Public Utilities, and in
accordance with standard specifications on file in the Office of
the Director of Public Utilities; and/or that a bond, certificate
of deposit, letter of credit, or cash, in an amount and form sat-
isfactory to the City of Anaheim shall be posted with the City to
guarantee the installation of the above-mentioned requirements.
3. That the owner of subject property shall pay to the City
of Anaheim the sum of sixty (60) cents per front foot along Lincoln
Avenue and Bel Air Street for tree planting purposes.
4. That trash storage areas shall be provided in accordance
with approved plans on file with the Office of the Director of
Public Works.
5. That fire hydrants shall be installed and charged, as
required and determined to be necessary by the Chief of the Fire
Department, prior to commencement of structural framing.
6. That subject property shall be served by underground
utilities.
7. That drainage of subject property shall be disposed of
in a manner satisfactory to the City Engineer.
8. That the owner of subject property shall pay to the City
of Anaheim the appropriate park and recreation in-lieu fees as de-
termined to be appropriate by the City Council, said fees to be
paid at the time the building permit is issued.
9. That appropriate water assessment fees, as determined
by the Director of Public Utilities, shall be paid to the City of
Anaheim prior to the issuance of a building permit.
10. That a six (6) foot masonry wall shall be constructed
along the east property line.
11. That a grading permit will be obtained prior to any
grading or on-site excavation activities.
12. That mitigating measures contained in Environmental
Impact Report No. 204, certified by the Planning Commission on
August 1, 1977, will be complied with.
13. Prior to the introduction of an ordinance rezoning sub-
ject property, Condition Nos. 1, 2 and 3, above mentioned, shall
be completed. The provisions or rights grantea by this resolution
shall become null and void by action of the Planning Commission
unless said conditions are complied with within one year fror„ the
data hereof, or such further time as the Planning Commission may
grant.
14. That Condition Nos. 4, 6, 7, 10 and 12, above lc,entioned,
shall be complied with prior to final buildinc and zoning inspec-
tions.
1 2,1 IT FURTHER aLsoLvED that the City Attorney be, and
he is hereby, authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish tie objects herein found and deter-
mined to be necessary and proper.
mHE FOREGOING RESOL1T'ION is approved and adopted by the
City Council of the Citv of Anaheim this 13th day of September,
1977.
