A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING CONDITIONAL USE PERMIT
NO. 1714
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
from MICHAEL J. and JERI J. GARAN, owners, to permit an office
and storage facilities on the property situated in the State of
California, County of Orange, City of Anaheim, described as
follows:

as per map recorded in book 14, page 25, Miscellan-
eous Maps, in the office of the County Recorder of
said County.
EXCEPTING THEREFROM the Easterly 20 feet.

AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on July 6, 1977, notices of which said public hearing
were duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, investi-
gation and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. PC77 -140 denying Conditional Use Per-
mit No. 1714; and
WHEREAS, thereafter within twenty -two (22) days from the
date of the adoption of said resolution, a written appeal was filed
with the City Council protesting the action of the City Planning
Commission in denying said conditional use permit and said appeal
was set for public hearing on August 16, 1977, at the City Hall in
the City of Anaheim, and notices of such public hearing were duly
given as required by law and the provisions of Title 18, Chapter
18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful considera-
tion of the recommendations of the City Planning Commission and all
evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a conditional
use permit is authorized by the Anaheim Municipal Code.
2. The proposed use will not adversely affect the adjoining
land uses and the growth and development of the area in which it
is proposed to be located.
3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a
manner not detrimental to the particular area nor to the peace,
health, safety and general welfare.
4. The traffic generated by the proposed use will not im-
pose an undue burden upon the streets and highways designed and
improved to carry the traffic in the area.
5. The granting of the conditional use permit under the
conditions imposed will not be detrimental to the peace, health,
safety and general welfare of the citizens of the City of Anaheim.
IOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the action of the City Planning Commission
denying said conditional use permit be, and the same is hereby, re-
versed and that Conditional Use Permit No. 1714 be, and the same is
hereby, granted permitting an office and storage facilities on the
aforedescribed property with waivers of the following sections of
the Anaheim Municipal Code:

SECTION 18.32.020
Permitted uses. (Outdoor
storage not permitted in
the RM -2400 Zone)
SECTION 18.32.063.011 Minimum landscaped setback.
(15 and 20 feet required;
none existing)
That said conditional use permit is granted subject to the follow-
ing conditions:
1. That the owner(s) of subject property shall deed to the
City of Anaheim a strip of land 53 feet in width from the center-
line of the street along Center Street and a strip of land 25 feet
in width from the centerline of the street along Coffman Street
for street widening purposes; and that encroachment permits shall
be obtained, if necessary, for any existing structure which may
encroach into the ultimate right -of -way.
2. That the owner(s) of subject property shall pay to the
City of Anaheim the sum of $2.00 per front foot along Center Street
and Coffman Street for street lighting purposes.
3. That sidewalks shall be installed along Center Street and
Coffman Street as required by the City Engineer and in accordance
with standard plans and specifications on file in the Office of the
City Engineer.
4. That subject property shall be served by underground
utilities.
5. That drainage of subject property shall be disposed of
in a manner satisfactory to the City Engineer.
6. That the existing structure shall be brought up to the
minimum standards of the City of Anaheim, including the Uniform
Building, Plumbing, Electrical, Mechanical and Fire Codes as adop-
ted by the City of Anaheim.
7. That subject property shall be developed substantially
in accordance with Plans and specifications on file with the City
of Anaheim marked Exhibit No. 1.
8. That all outdoor storage areas shall be effectively view
screened, as stipulated to by the petitioner, from adjoining prop-
erties and streets by the following: (a) The existing six (6)
foot high chain link fence shall be entirely interwoven with red-
wood or cedar slats; and (b) a minimum three (3) foot wide land-
scaped buffer shall be located inside and adjoining said fence,
said buffer to consist of plant materials approved by the Planning
Department as to species, size, and spacing; and, further, that
said planting shall be permanently maintained in a neat and orderly
manner.
9. That all outdoor storage areas shall be paved, as stipu-
lated to by the petitioner.
10. That there shall be no guard dogs or other guard animals
on the subject property.
11. That the subject use is granted for a period of three (3)
years provided, however, that upon written request by the petitioner,
an additional period of time may be approved by the City Council.
12. That Condition Nos. 1, 2, 8 and 9, above mentioned, shall
be complied with within a period of sixty (60) days from date hereof
or such further time as the City Council may grant.
13. That Condition Nos. 3, 4, 5, 6 and 7, above- mentioned,
shall be complied with prior to final building and zoning inspec-
tions.
BE IT FURTHER RESOLVED that the City Council hereby re-
serves the right to revoke such Conditional Use Permit for good
cause or failure of said owners, their heirs, successors or assigns
to comply with the Anaheim Municipal Code and regulations and the
conditions herein.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 16th day of August, 1977.
