OF ANAliElat DENYING CONDITIONAL USE PEPJIIT NO.
1706.
UrIEREAS, the City Planning Commission of the City of
Anaheim did receive a reauest for a Conditional Use Permit from
STEPHEN HOPKINS DEVEL0FilEAT COITANY, owner; SHORT STOP DRIVE-THaU,
agent, to permit a drive-through restaurant with a waiver of mini-
mum number of parking spaces on the following described property:
All that certain land situated in the State of Cali-
fornia, County of Orange, City of Anaheim, described
as follows:
That portion of those certain parcels of land shown
as "Tax Bavha 0.452 Acres" and "Hermine Bavha Lowe
7.806 Acres", as per map filed in Book 7, nage 12 of
Records of Survey, in the office of the County Re-
corder of said County, shown as Lot 3 on the Parcel
]Iap recorded in Book 74, page 17 of Parcel :laps in
said office of the County Recorder.
AND UHERLAS, the City Planning Cammission did hold a
public hearing at the City Hall in the City of Anaheim upon said
request on June 20, 1977, notices of which said public hearing
were duly given as required by law and the provisions of Title 18,
Chanter 13.76 of the Anaheim nunicipal Code; and
WHEREAS, said Commission, after due inspection, investi-
gation and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. PC77-125 granting Conditional Use
Permit No. 1706; and
WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, an interested party
or the City Council on its own motion caused the review of said
Planning Commission action at a public hearing before the Citv
Council on August 2, 1977, at the City Hall, in the City of
Anaheim, and notices of such public hearing were duly aiven as
required by law and the provisions of Title 13, Chapter 13.76 oi
the Anaheim nunicipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duiv hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evi&ence and reports; and
WHMEAS, the Citv Council does finra, after careful con-
sideration of the action of the City Planning Commission and all
evidence and reports offered at said hearing, that Conditional Use
Permit No. 1706 should be denied.
THEREFO ar] IT RESOINZD by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion granting Conditional Use Permit No. 1706 be, and the same is
hereby reversed, and that the request of STEPHEN HOPKINS DEVELOP-
MENT COMPANY, owner; SHORT STOP DRIVE-TERU, agent, to permit a
drive-through restaurant with waiver of the rzinimum huLAber of
parking spaces on the hereinabove described property be, anr: the
sarz is hereby, denied.
