RESOLUTION NO. 77R -121
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING CONDITIONAL USE PERMIT
NO. 1683
WHEREAS, the City Planning Commission of the Citv of
Anaheim did receive an application for a conditional use permit
from Mr. and Mrs. F. R. Hall, owners, to permit a private school
on the following described property:
That portion of the North half of the West half of the
Northeast quarter of the Northwest quarter of Section
28, Township 4 South, Range 10 West, in the Rancho Las
Bolsas, City of Anaheim, County of Orange, State of
California, as shown on a map recorded in Book 51, Page
10 of Miscellaneous Maps, in the office of the County
Recorder of said County, described as follows:
BEGINNING at the intersection of the centerline of
Katella Avenue with the Westerly line of that certain
strip of land, 50.00 feet in width, described in deed
to the Orange County Flood Control District recorded
October 14, 1957 in Book 4069, Page 188, Official Rec-
ords, in the office of the County Recorder of said
County; said point being distant S. 89° 13' 30" W.,
661.50 feet from the centerline intersection of said
Katella Avenue and Ninth Street, as said intersection
is shown on the map of Tract No. 3240 recorded in Book
113, Pages 1, 2 and 3 of Miscellaneous Maps, in the
office of the County Recorder of said County; thence
along said centerline of Katella Avenue, S. 89° 13'
30" W., 132.00 feet to the West line of the Easterly
132.00 feet of said North half of the West half of
the Northeast quarter of the Northwest quarter of
Section 28; thence along said West line, S. 0° 55'
30" E., 186.00 feet; thence parallel with said center-
line of Katella Avenue, S. 89° 13' 30" W., 10.18 feet
to the Northeast corner of Lot 37 of said Tract No.
3240; thence along the boundary of said Tract No.
3240 the following courses and distances:
S. 0° 56' 24" E., 128.98 feet; thence N. 89° 13' 30"
E., 131.30 feet to a point on a non tangent curve in
the Westerly line of said strip of land, 50.00 feet in
width, described in deed to the Orange County Flood
Control District recorded in Book 4069, Page 188,
Official Records, said curve being concave Westerly
and having a radius of 1175.00 feet, a radial line to
said point bears S. 83° 07' 59" E.; thence leaving the
boundary of said Tract No. 3240, Northerly 159.79 feet
along said curve through a central angle of 7° 47' 31
thence tangent to said curve, and continuing along the
Westerly line of said strip of land, 50.00 feet in width
described in deed to the Grange County Flood Control Dis-
trict, N. 0° 55' 30" W., 155.65 feet to the POINT OF
BEGINNING.

AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on January 31 19 77, notices of
which said public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing, did adopt its Resolution No. PC77 -27 Series
granting Conditional Use Permit No.
1683 subject to certain conditions and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the City
Planning Commission in granting said conditional use
permit and did thereupon fix the 22ndday of PPhriA ry
19 77, as the time and the Council Chamber in the City Hall of
the City of Anaheim as the place for a public hearing upon said
conditional use permit, and notices of such public hearing were
duly given as required by law and the provisions of Title 13,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful consid-
eration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning
Commission granting said conditional use permit be,
and the same is hereby, sustained and that Conditional
Use Permit No. 1683 be, and the same is hereby, granted
permitting a private school on the aforedescribed property,
subject to the following conditions:
1. That this Conditional Use Permit is granted subject to
the completion of Reclassification No. 76- 77 -32, now pending.
2. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit Nos. 1 and 2.
3. That Condition No. 1, above mentioned, shall be complied
with prior to the commencement of the activity' authorized under
this resolution, or prior to the time that the building permit is
issued, or within a period of one year from date hereof, whichever
occurs first, or such further time as the Planning Commission
and /or City Council may grant.
4. That Condition No. 2, above- mentioned, shall be complied
with prior to final building and zoning inspections.
BE IT FURTHER RESOLVED that the City Council hereby re-
serves the right to revoke such Conditional Use Permit for good
cause or failure of said owner(s), their heirs, successors or
assigns to comply with the Anaheim Municipal Code and regulations
and the conditions therein.
THE FOREGOING RESOLUTION is approved and signed by me
this 22nd day of February, 1977.

5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
