A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2831, IN PART.
WHEREAS, after a request for variance by Jane W.
Inch, owner; Dale L. Ingram, agent, was received, a public
hearing before the Planning Commission of the City of
Anaheim was held upon due and proper notice as a result of
which Variance No. 2831 was granted, in part, covering the
following described property:
The Southwest quarter of the Southwest quarter
of the Northeast quarter of Section 27,
Township 4 South, Range 10 West, in the Rancho
San Juan Cajon de Santa Ana, City of Anaheim,
County of Orange, State of California, as per
map recorded in Book 51, Page 10, of Miscel-
laneous Maps, in the office of the County
Recorder of said county, lying Easterly of the
Easterly line and the Northerly and Southerly
prolongation thereof, of the land described in
a lease to the Bank of America, National Trust
and Savings Association recorded in Book 6226,
Page o06, Official Records.
Except any portion thereof lying within the land
confirmed to John Vincent Thompson, et ux., by
judgment rendered under Case No. 41958 and No.
40910 in the Superior Court of the State of
California a copy of which was recorded
September 1, 1943, in Book 1200, Page 2d7, of
Official Records.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the following
findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.

I,.., THEREFORE, BE IT RESOLVE_ by the City Council
of the City of Anaheim, that a conditional zoning variance be,
and the same is hereby granted, in part, permitting the construc-
tion of a 139 -unit apartment complex on the property hereinbe-
fore described with a waiver of the following section of the
Anaheim Municipal Code:
SECTION 18.34.06.2.032 - Minimum floor area.
(700 square feet required;
550 square feet proposed)
That said variance be granted, in part, subject to the
following conditions:
1. That this Variance is granted subject to the
completion of Reclassification No. 76-77-7, now pending.
2. That subject property shall be developed
substantially in accordance with plans and specifications on
file with the City of Anaheim marked Exhibits Nos. 1 through
10 (Revision No. 1); provided, however, that the enclosed
carports and all turning radii for parking and driveway areas
shall be provided in accordance with Code standards, as
stipulated to by the petitioner.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owner, her heirs, successors or
assigns to comply with the Anaheim Municipal Code and regula-
tions and the conditions herein. Said variance is granted,
in part, for the term prescribed by the Anaheim Municipal
Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 28th day of December, 1976.
