A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM 21UNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City
of Anaheim did hold a public hearing in Reclassification Pro-
ceedings No. 76-77-18 to consider an amendment to Title 18 of
the Anaheim ',iunicipal Code relating to zoning, and to consider
a change in the boundaries of the zone or zones hereinafter
mentioned and described, and at said hearing did receive evidence
and reports from persons interested therein and from its staff;
and
WHEREAS, within a period of forty days following said
hearing, the Planning Commission did duly adopt a resolution .
containing a report of its findings, a summary of the evi:aence
presented at said hearing, and a recommendation that the proposed
amendment be adopted by the City Council and that a certain zone
or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City Council did fix the 30th day of
November , 1976 , and continued to the - - -day of - - - ,
19 , as the time, and the City Council Caambers in- ti he City
Hall of the City of Anaheim as the place for a public hearing
upon said proposed amendment to Title 18 of the Anaheim Municipal
Code, and the exclusion of said property, hereinafter described,
from the zone or zones in which it is now situated and the incor-
poration thereof in the zone or zones hereinafter set forth, and
did give notice thereof in the manner and form provided in said
Title 18 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard, and did receive evidence and reports, and did thereupon
consider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings and
recommendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Cole should
be adopted and that the property hereinafter describer: s1rould
be excluded from the zone or zonas in which it is now situated
and incorporated in the zone or zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Munic pal Code
be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:

That Portion of Lot 5 of Hiles Rancho, in the City
of Anaheim, County of orange, State of California,
as per map recorded in Book 4, Page 7 of Aiscellan-
eous Maps, in the office of the County Recorder of
said County, described as follows:
Beginning at the Northwesterly Corner of said Lot 5,
said corner also being the point of beginning of the
legal description of Parcel 1 in the Grant Deed from
Dora A. Littleton to the State of California, re-
corded July 26, 1956 in Book 3591, Page 64,'Official
Records of said County; thence traversing the follow-
ing courses of said legal description; thence south-
erly along the westerly line of said Lot 5 227.36
feet to the True Point of Beginning of this descrip-
tion; thence at right angles to said westerly line
easterly 40.00 feet; thence continuing along said
legal description line North 100 451 00" East 111-80
feet; thence North 320 541 59" East, 65.19 feet;
thence South 380 251 29" East 462.95 feet; thence
North 520 531 11" East, 477.04 feet; thence North
640 261 06" East, to the northerly line of said Lot
5; thence South l* 031 38" East 386.32 feet to the
Northerly line of the land of Joseph William Heinz
as described in Certificate of Title #2117 on file
in the office of the Registrar of Titles of said
County; thence South 74* 271 44" West 1033.07 feet
along said Northerly line, and along the Southerly
line of the land described in the lease to Frojen-
Lund Investments, Inc., as lessee, recorded February
2, 1962 in Book 6003, Page 135 of Official Records,
records of said County, to a point on the west line
of said Lot 5 which is 360.73 feet North of the South-
west corner of said Lot; thence Northerly along said
west line to the True Point of Beginning.
EACEPTING THEREFROM that portion thereof within the
limits of the City of Fullerton? State of California.
be excluded from the "CH" COMMERCIAL, HEAVY ZONE and incorporated
in the "MY LIMITED INDUSTRIAL ZONE, subject to the following
conditions:
1. That sidewalks shall be installed along Harbor Boulevard,
as required by the City Engineer and in accordance with standard
plans and specifications on file in the Office of the City Engineer.
2. That street lighting facilities along Harbor Boulevard
shall be installed as required by the Director of Public Utilities,
and in accordance with standard plans and specifications on file
in the Office of the Director of Public Utilities and/or that a
bond, certificate of deposit, letter of credit, or cash in an amount
and form satisfactory to the City of Anaheim shall be posted with
the City to guarantee the installation of the above-mentioned re-
quirements.
3. That trash storage areas shall be provided in accordance
with approved plans on file with the office of the Director of
Public Works.
4. That fire hydrants shall be installed and charged as
required and determined to be necessary by the Chief of the Fire
Department, prior to commencement of structural framing.

5. That appropriate water assessment fees, as determined by
the Director of Public Utilities, shall be paid to the City of
Anaheim prior to issuance of a building permit.
6. That subject property shall be served by underground
utilities.
7. That drainage of subject property shall be disposed of
in a manner satisfactory to the City Engineer.
8. That developer shall pay to City the cost for installa-
tion of a traffic signal as approved by the Traffic Engineer at
the northernmost driveway on Lemon Street at such time as said
signal is deemed necessary by the Traffic Engineer.
9. Prior to the introduction of an ordinance rezoning sub-
ject property, Condition No. 21 above-mentioned, shall be completed.
The provisions or rights granted by this resolution shall become
null and void by action of the City Council unless said conditions
are complied with within one (1) year from the date hereof, or such
further time as the City Council may grant.
10. That Condition Nos. 1, 3 6 and 7, above-mentioned, shall
be complied with prior to final building and zoning inspections.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby, authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and deter-
mined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
