A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SUPERSEDING RESOLUTION NO. 75R-291
AND AUTHORIZING CERTAIN PERSONS TO REPRESENT
THE CITY OF ANAHEIM IN SMALL CLAIMS ACTIONS
AND AUTHORIZING SAID PERSONS TO C014PROMISEE OR
SETTLE SMALL CLAI14S ACTIONS IF THE AMOUNT TO
BE PAID IS $500.00 OR LESS.
WHEREAS, the City Council of tie City of Anaheim does
find and determine that it is necessary in the normal course of
City business to institute, prosecute, defend and consummate
litigation involving small amounts, the jurisdiction of which
is vested in the Small Claims Court, being amounts of less than
$500.00; and
WHEREAS, it is deemed desirable by the City Council
of the City of Anaheim that certain City employees should be
authorized to act in the City's behalf in connection with Small
Claims actions.
WHEREAS, California Government Code, Section 935.4
provides for the authorization of an employee of the City to
perform duties connected with the compromise or settlement of
such claims on behalf of the City; and
WHEREAS, the handling of the compromise and settlement
of certain Small Claims actions against the City can be more
effectively pursued and concluded if the authorized City Small
Claims Representatives are authorizers to perform such duties and
to sign agreements and other documents related to such compro-
mises or settlements on behalf of the Citv.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the Citv of Anaheim that the follov7ing named persons, to wit:
Donald ?Metzger - Commercial Office Supervisor
Ronald Howard - Assistant City T=reasurer
Judith Knight - Senior Credit Clerk
be, and the same are hereby, authorized to corix.ience, prosecute
and consummate Small Claims litigation for, in behalf of, and in
the name of the City of Anaiheirt, and that they, and each of them,
are authorized to file Small Claims petitions, -.o appear at Small
Claims hearings, to represent -Eae City, and to file satisfaction
of judgment in Small Claims actions, and to deo any and all other
things necessary and convenient in the processing of Small Claims
actions.
BE IT FURTHER RESOLVED that the above named persons are
hereby authorized to compromise or settle Small Claims actions for,
in behalf of, and in the name of the City of Anaheim if the amount
to be oaid is in the sxrcn of $500.00 or less and they are hereby
authorized to execute and sign in behalf of the City of Anaheim,
any and all agreements and other documents related thereto.

be, and it is hereby, superseded by the foregoing Resolution.
