RESOLUTION NO. 68R -356
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING VARIANCE NO. 1935.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from FRANK
M. CLAYTON, JR., DICK H. ABLES and LEONARD R. SMITH, owners of
certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
That portion of lot 4 in Block 12 of "Subdivision of the
South half of Section 21, Township 4 South, Range 10 West,
S.B.B. M." being a part of the Fairview Colony Tract, in
the County of Orange, State of California, as per map re-
corded in Book 1, page 33 of Miscellaneous Maps, in the
Office of the County Recorder of said County, described as
follows:
Beginning at the intersection of the north line of lot 4
in said block 12 extended westerly with the center line of
Garden Grove Road (now Euclid Avenue), as shown on said map;
thence easterly along said westerly extension and the said
north line of said lot 4, 210 feet; thence South parallel
to the center line of Garden Grove Road, 162 feet; thence
west parallel to the north line of lot four, and its westerly
extension, 210 feet to a point in the center line of said
Garden Grove Road, thence along said center line 162 feet to
the point of beginning.
Parcel 2
That portion of Lot 4 in block 12 of Subdivision of the
south half of section 21, in Township 4 South, Range 10 West,
San Bernardino Base and Meridian, being a part of the Fair-
view Colony Tract, partly in the City of Anaheim and partly
in the County of Orange, State of California, as per map re-
corded in Book 1, page 33 of Miscellaneous Maps, in the
Office of the County Recorder of said County included within
the following described land:
Beginning at a point in the centerline of Garden Grove Road,
now Euclid Avenue, as shown on said map, 162 feet south of
the intersection of said centerline with the north line of
said lot 4 extended westerly; thence East parallel to said
extended line and the north line of Lot 4, 210 feet to a
point; thence South parallel to the centerline of said Garden
Grove Road, 77 feet to a point; thence West parallel to the
north line of said Lot 4, and its westerly extension, 210
feet to a point in the centerline of Garden Grove Road;
thence North along said centerline, 77 feet to the point of
beginning.
Parcel 3
That portion of Lot 4 in Block 12 of "Subdivision of the
South half of section 21, Township 4 South, Range 10 West,
San Bernardino Base and Meridian, being a part of the Fair-
view Colony Tract, in the City of Anaheim, County of Orange,
State of California, as per map recorded in Book 1, page 33
of Miscellaneous Maps, in the Office of the County Recorder
of said County, described as follows:

Beginning at a point in the center line of Garden Grove
Road (now Euclid Avenue) as shown on said map, 239 feet
South of the intersection of said center line with the
North line of said Lot 4 extended westerly; thence East,
parallel to said extended line and the North line of Lot
4, 210 feet to a point; thence South, parallel to the
center line of said Garden Grove Road, 77 feet to its
intersection with a line parallel to and 30 feet northerly
from the North line of the South 10 acres of Lots 3 and 4
in said Block 12; thence West along said parallel line,
210 feet to a point in the center line of said Garden
Grove Road; thence North along said center line 77 feet
to the point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on
January 3, 1968, notice of which said public hearing was duly
given as required by law and the provisions of Title 18, Chapter
18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission after due in-
spection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. PC68 -5 denying
Variance No. 1935; and
WHEREAS, thereafter within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in denying said variance and did
set a public hearing thereon to be held on the 30th day of
January, 1968, at 1:30 o'clock P.M. in the City Hall in the City
of Anaheim, and notice of such public hearing was duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be ade-
quately developed and used under the present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commission
denying Variance No. 1935 be, and the same is hereby sustained,
and that the petition for a zoning variance to permit the estab-
lishment of two free standing signs on the property hereinbefore
described, with a waiver of the minimum distance between free-
standing signs (Section 18.62.090(b -1) of the Anaheim Municipal
Code), be, and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 25th day of June, 1968.

1968.
