1968-347RESOLUTION NO. 68R -347 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 67 -68 -85 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to,con- sider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing, and a recommendation that a certain zone or zones be changed as more particularly set forth in said resolution, and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planing Commission, the City Council did fix the 25th day of June 1968 as the time and the City Council Chambers in t e City H of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones set forth in said proposed amendment; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hear- ing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 67 -68 -85 That portion of the fractional Northwest quarter of Section 2, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in Book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the Southwest corner of the East one -half of the East one -half of the fractional Northwest quarter of said Section 2; thence North 89° 59' 45" West along the South line of the Northwest one quarter of said Section 2, Township 4 South, Range 10 West a distance of 228.63 feet to the Southeast corner of the land described in Deed to the State of California, recorded March 19, 1959, in Book 4632, page 181 of Official Records; thence along the boundary of said land to the State of California, the following courses and distances: North 0° 00' 15" East 29.97 feet to the beginning of a curve concave Northerly having a radius of 38.00 feet, a radial line through said point bears South 0° 00' 15" West; thence Westerly along said curve through a central angle of 48° 48' 43" an arc distance of 32.37 feet to the beginning of a reverse curve concave Southerly having a radius of 44.00 feet; thence Westerly along said curve through a central angle of 62° 43' 56" an arc distance of 48.17 feet to a point in the Southerly line of the Orange County Flood Control Channel, 65.00 feet wide; said point being a point in a curve in said Southerly line concave Northwesterly having a radius of 527.50 feet, a radial line through said point bears South 47° 55' 04" East; thence Northeasterly along said curve through a central angle of 10° 57' 57" an arc distance of 100.96 feet to the beginning of a reverse curve in said Southerly line, concave Southeasterly having a radius of 472.50 feet; thence Northeasterly along said curve through a central angle of 38° 01' 21" an arc distance of 313.56 feet to the West line of said East one -half of the East one -half of the Northwest quarter; thence South 0° 46' 46" East 335.01 feet to the point of beginning. be excluded from R -A, AGRICULTURAL ZONE, to R -2, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Burton Street, for street widening purposes. 2. That the owner of subject property shall deed to the City of Anaheim a cul -de -sac, with a minimum radius of 40 feet, for the extension and terminus of Blossom Lane. 3. (a) That all engineering requirements of the City of Anaheim along Burton Street and Blossom Lane, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineer- ing requirements. -2- 4. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Burton Street and Blossom Lane, for street lighting purposes. 5. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Burton Street and Blossom Lane, for tree planting purposes. 6. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 7. That the alley shall remain a private alley; PROVIDED, HOWEVER, that dedication shall be made to the City of Anaheim of the necessary easements for City services. 8. That conditions nos. 1, 2, 3(b), 4, 5 and 7 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
