A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 1026
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from Arno H. Stovall, Jr. and Dorothy M. Wileman, 11945 Cameo
Place, Granada Hills, California, to establish an automatic car
wash, with accessory gas pumps, on the following described
property situated in the City of Anaheim, County of Orange,
State of California, to wit:
Beginning at the north quarter corner of Section 14,
Township 4 South, Range 11 West, S.B.B. M., said
north quarter corner being the center line intersection
of Lincoln Avenue and Western Avenue; thence along the
east line of the northwest quarter of said Section,
said east line being the center line of Western Avenue
South 0° 16' 25" East 201.00 feet; thence South 89° 41' 29"
West parallel with the north line of said Section 45.00
feet to the westerly right of way line of Western
Avenue, said point being the true point of beginning
of this description; thence South 0° 16' 25" East
along said westerly right of way line 129.00 feet;
thence South 89° 41' 29" West parallel to said north
line 150.00 feet; thence North 0° 16' 25" West parallel
to said east line 129.00 feet; thence North 89° 41' 29"
East parallel to said north line 150.00 feet to the
true point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on May 20, 1968 notices of which
said public hearing were duly 'given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing did adopt its Resolution No. PC68 -137 Series
deriving Conditional Use Permit No. 1026
and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in denying said Conditional
Use Permit and said appeal was set for public hearing on
June 25, 19 68 at the City Hall, in the City of
Anaheim, and notices of such public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and

WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commis-
sion and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion in denying said conditional use permit be, and the
same is hereby disapproved and that Conditional Use Permit
No. 1026 be, and the same is hereby, granted permitting
the establishment of an automatic car wash, with accessory gas
pumps, on the property hereinbefore described, subject to the
following conditions:
1. That a parcel map to record the approved division
of subject property shall be submitted to the City
of Anaheim for approval, and then recorded in the
Office of the Orange County Recorder, prior to the
issuance of a building permit, or within a period
of 180 days from date hereof, whichever occurs
first, or such further time as the City Council
may grant.
2. That trash storage areas shall be provided in
accordance with approved plans on file in the
Office of the Director of Public Works and
Superintendent of Streets, prior to final zoning and
building inspections.
3. That any lighting on subject property shall be
directed away from the property lines to protect
the residential area immediately to the south,
and that this condition shall be complied with
prior to final building and zoning inspections.
4. That subject property shall be developed sub-
stantially in accordance with plans and speci-
fications on file with the City of Anaheim,
marked Exhibits Nos. 1, 2, 3, 4, 5 and 6, and
the Plot Plan, marked Revision No. 1, indicating
a 25 -foot access on the north to the property
to the west.
5. That in the event it is determined at a later
date to install a mechanical drying system,
prior approval shall be obtained from the City
Planning Commission and the City Council.
THE FOREGOING RESOLUTION is approved and signed by
me this 25th day of June, 1968.
