A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 1960.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition for zoning variance from
Richard William Henning, owner of certain real property
situated in the City of Anaheim, County of Orange, State of
California, described as follows:
Parcel 1: That portion of the Northwest quarter
of the Southwest quarter of Section 7, Township 4
South, Range 9 West, S. B. B. M., described as
follows:
Beginning at the intersection of the West line of
said Section 7 with the center line of Anaheim
Olive Boulevard, as described in deed to the County
of Orange, recorded May 17, 1915 in Book 275, page
85 of Deeds; thence South 78° 55' 05" East 680.79
feet along said center line to the West line of
land described in deed to the State of California,
recorded November 5, 1948 in Book 1725, page 422 of
Official Records; thence North 11° 04' 55" East
69.80 feet to the Northwest corner of said land of
the State of California; thence South 78° 54' 38"
East 44.08 feet to the Southwest corner of land
described in deed to Ottilie Henning and son,
recorded June 28, 1949 in Book 1865, page 419 of
Official Records; thence North 0° 05' 45" East
636.42 feet along the West line of said land of
Ottilie Henning to the North line of the South
half of the South half of the North half of the
Northwest quarter of the Southwest quarter of said
Section 7; thence Westerly 724.18 feet along said
North line to the West line of said Section 7;
thence Southerly 563.57 feet to the point of
beginning.
EXCEPTING THEREFROM that portion conveyed to Alpha
Beta Acme Markets, Inc., a corporation by deed
recorded December 21, 1961 in Book 5951, page 18
of Official Records.
Parcel 2: That portion of the Northwest quarter
of the Southwest quarter of Section 7, Township 4
South, Range 9 West in the Rancho San Juan Cajon
de Santa Ana, as shown on a Map recorded in Book
51, page 10 of Miscellaneous Maps, records of
Orange County, California, described as follows:

Beginning at the intersection of the center line
of Anaheim Olive Road as described in deed recorded
May 17, 1915, in Book 275, page 85 of Deeds with
the West line of the Southwest quarter of Section 7,
Township 4 South, Range 9 West, S. B. B. M.; thence
South 78° 55' 30" East along said center line 738.33
feet; thence North 0° 05' 20" East 71.11 feet to a
point in the Northerly line of the parcel of land
described in deed to the State of California, recorded
November 5, 1948 in Book 1725, page 422 of Official
Records, said point being the true point of beginning
for this description; thence from said true point
of beginning South 78° 55' 03" East along said
Northerly line 605.88 feet to a point in the East line
of the Northwest quarter of the Southwest quarter of
said Section 7; thence North 0° 09' 50" East along
said East line 754.64 feet to an intersection with
the North line of the South half of the South half
of the North half of the Northwest quarter of the
Southwest quarter of said Section 7; thence South
89° 49' 50" West along said North line 595.75 feet;
thence South 0° 05' 20" West 636.42 feet to the
true point of beginning.
EXCEPTING therefrom the East 432.00 feet.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on
May 6, 1968, notice of which said public hearing was duly given
as required by law and the provisions of Title 18, Chapter
18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission after due
inspection, investigation and studies made by itself and in
its behalf, and after due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No.
PC 68 -130, denying Variance No. 1960; and
WHEREAS, thereafter within twenty -two (22) days
from the date of the adoption of said resolution, the City
Council did elect, upon its own motion, to review the action
taken by the City Planning Commission in denying said
variance and did set a public hearing thereon to be held on
the llth day of June 1968, at 1:30 o'clock P.M. in the City
Hall in the City of Anaheim, and notice of such public
hearing was duly given as required by law and the provisions
of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, the City Council does find that:
1. There is no substantial property right
possessed by other property in the same
vicinity and zone and denied the subject
property.
2. It appears that the subject property can
be adequately developed and used under
the present zone.

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission denying variance No. 1960 be, and the same is
hereby sustained, and that the petition for a zoning variance
to permit the construction of a two story, multiple family
residential development within 150 feet of an R -A Zone,
on the property hereinbefore described, with waivers of the
maximum building and structural height limitations, be,
and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed
by me this llth day of Julie 1968.
