A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM OPPOSING THE PLACING OF PUBLIC
DISTRICTS CONCERNED WITH WATER, GAS, OR ELEC-
TRICITY UNDER THE JURISDICTION OF THE PUBLIC
UTILITIES COMMISSION AS PROPOSED IN ASSEMBLY
BILL 1460 AND ASSEMBLY CONSTITUTIONAL AMEND-
MENT 42.
WHEREAS, the monopolistic nature of privately owned
utilities and public districts concerned directly or indirectly
with the development, control, or distribution of water, gas, or
electricity for public use requires that there exist some medium
for public expression on, and, if necessary, regulation of, rates,
services, installations and all other performance; and
WHEREAS, the appointive Public Utilities Commission is
the medium for public regulation of privately owned utilities; and
WHEREAS, elected boards of directors are the medium for
public regulation of public districts; and
WHEREAS, Assembly Bill 1460 and Assembly Constitutional
Amendment 42 would place all public districts under the juris-
diction of the Public Utilities Commission; and
WHEREAS, placement of public districts under the juris-
diction of the Public Utilities Commission would remove public
regulation from locally elected directors and place decisions on
rates, services, installations, and all other performance in the
hands of an appointive state commission; and
WHEREAS, superimposition of the appointive Public Utili-
ties Commission on top of locally elected directors would result
in duplicated public regulation which could, through delays caused
by regulatory disagreements, adversely affect among other things,
public bond issues, interest rates, and contract performance.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Anaheim that the City strongly opposes the placing
of public districts under the jurisdiction of the Public Utilities
Commission as proposed in Assembly Bill 1460 and Assembly Consti-
tutional Amendment 42.
BE IT FURTHER RESOLVED, that the City Clerk is hereby
directed forthwith to transmit copies of this resolution to
Assemblyman Lester A. McMillian, Assemblyman Robert Badham,
Assemblyman John Briggs, Assemblyman Robert Burke and Assemblyman
Kenneth Cory.
THE FOREGOING RESOLUTION is approved and signed by me
