1968-308RESOLUTION NO. 68R -308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1024 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from Lonnie M. Dunn, Mary R. Dunn, William C. Sangster and Margaret N. Sangster, 2019 South Ritchey Street, Santa Ana, California, to construct a two story, 34 -unit motel on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The Northerly 100.00 feet, measured along the Easterly line, of that portion of Lot 2 of Tract No. 71, as shown on a Map thereof recorded in Book 10, page 22 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southwest corner of Lot 3 of said Tract No. 71, said Southwest corner also being the East quarter Section corner of Section 26, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map thereof recorded in Book 51, page 10 of Miscellaneous Maps, records of said County; thence along the Southerly line of said Lot 3, North 89° 59' 00" East 275.00 feet; thence South 0° 01' 00" East 280.00 feet to the true point of beginning; thence continuing South 0° 01' 00" East 287.04 feet to the Southerly line of the Northerly 567.04 feet of said Lot 2; thence Westerly along said Southerly line to the center line of State College Boulevard, formerly Placentia Avenue, as described in deed to the County of Orange, recorded March 22, 1920 in Book 358, page 19 of Deeds, records of said County; thence Northerly along said center line to a line that is parallel with the Northerly line of said Lot 2 and passes through the true point of beginning; thence Easterly along said last mentioned parallel line to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on May 6 1968 notices of which said public hearing were duly given as requ by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC68 -122 Sar.i:aa granting Conditional Use Permit No. 1024. subject to the conditions therein set forte and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granti said Conditional Use Permit and said appeal was set for public hearing on J�r�. 5. 19 68 at the City Hall, in the City of Ana and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in granting said conditional use permit be, and the same is hereby sustained and that Conditional Use Permit No. 1024 be, and the same is hereby, granted permitting the construction of a two story, 34 -unit motel (Section 18.64.020 (2 -c) of the A.M.C.) on the property hereinbefore described, subject to the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along State College Boulevard, for street lighting purposes. 2. That the owners of subject property shall pay to the City of Anaheim the sum of 15 per front foot along State College Boulevard for tree planting purposes. 3. That a Parcel Map to record the approved division of subject property shall be submitted to the City of Anaheim for approval, and then recorded in the Office of the Orange County Recorder. 4. That sidewalks and driveways shall be installed along State College Boulevard, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. ATTEST: 5. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 7. That all air conditioning facilities shall be properly shielded from view and the sound buffered from adjacent residential homes. 8. That all exterior lighting shall be directed downward and away from abutting property lines. 9. That Conditions Nos. 1, 2 and 3 above mentioned shall be complied with prior to the issuance of a building permit, or within a period of 180 days from date hereof, whichever occurs first, or such further time as the City Council may grant. 10. That Conditions Nos. 4,5,6,7 and 8 above mentioned shall be complied with prior to final building and zoning inspections. 11. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim; PROVIDED, HOWEVER, that a maximum of three (3) of the proposed units may be equipped with kitchen facilities. 12. That all signing on subject property shall be in confor- mance with the M -1 Zone. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
