1968-260WHEREAS, heretofore, on the 15th day of April, 1968,
suit was filed in eminent domain to acquire certain easements
in connection with the widening of Dale Avenue, being entitled,
"City of Anaheim vs. Louis J. Myers, et ux., et al., Orange
County Superior Court No. 159615; and
WHEREAS, in compromise of certain portions thereof,
the City is in receipt of easement deeds covering Parcel 2
and Parcel 5 as described in said action and it is in the
best interests of the City of Anaheim to accept said easement
deeds for recordation; and
WHEREAS, in connection with said litigation, the City
of Anaheim did deposit certain sums with the County Clerk of the
County of Orange as security for the taking of immediate posses-
sion of said parcels of land as follows:
As to Parcel 2 825.00
As to Parcel 5 866.70
which the City Council hereby finds to be a fair and reasonable
compensation for the easements taken; and
WHEREAS, A. T. Zamora and Audrey C. Zamora are willing
to accept the sum of $825.00 as settlement for Parcel 2, and
Samuel William Coffman and Audrey Dinwiddie Coffman are willing
to accept the sum of $866.70 as settlement for Parcel 5.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim, that it accept, and it does hereby accept,
easement deeds to Parcels 2 and 5 as the same are described in the
complaint in Orange County Superior Court Action No. 159615,
being entitled, "City of Anaheim vs. Louis J. Myers, et ux., et al."
and that the City Clerk be, and she is hereby directed to cause
said deeds to be recorded.
BE IT FURTHER RESOLVED that the City Council authorize
and direct, and it does hereby authorize and direct, the settle-
ment of said eminent domain litigation (to the extent of said
Parcels 2 and 5) for the sum of $825.00 as to Parcel 2 and
$866.70 as to Parcel 5.
AND BE IT FURTHER RESOLVED that the Finance Director
be, and he is hereby authorized and directed to draw a warrant
in the amount of $825.00 in favor of A. T. Zamora and Audrey C.
Zamora and a warrant in the amount of $866.70 in favor of
Samuel William Coffman and Audrey Dinwiddie Coffman; that
said warrants be delivered to the office of the City Attorney
for transmittal to the respective parties.
THE FOREGOING RESOLUTION is approved and signed by
me this 14th day of May, 1968.
