Resolution-PC2026-011RESOLUTION NO. PC2026-011
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ANAHEIM APPROVING TENTATIVE TRACT MAP NO. 19410
TO CREATE A ONE -LOT CONDOMINIUM MAP FOR 30 FOR -SALE
CONDOMINIUM UNITS, WHICH INCLUDE THREE AFFORDABLE
UNITS FOR MODERATE -INCOME HOUSEHOLDS (10 PERCENT)
AND MAKING CERTAIN FINDINGS IN CONNECTION
THEREWITH
(DEV2024-00067)
(601-623 SOUTH ANAHEIM BOULEVARD)
WHEREAS, the Planning Commission of the City of Anaheim (the "Planning
Commission") did receive a verified petition for the approval of Tentative Tract Map No. 19410
(the "Proposed Project") on certain real property located at 601-623 South Anaheim Boulevard in
the City of Anaheim, County of Orange, State of California, as generally depicted on Exhibit A
attached hereto and incorporated herein by this reference (the "Property"); and
WHEREAS, the Property is approximately 1.33 acres in area and is developed with
multiple commercial structures and associated site improvements. The Property is designated for
Mixed -Use Medium land uses in the General Plan. The property is in the "C-G" General
Commercial Zone and is subject to the zoning and development standards contained in Chapter
18.12 (Mixed -Use Zone) of the Anaheim Municipal Code (the "Code") pursuant to the provisions
of Code Section 18.08.030.150 and the General Plan designation for the Property; and
WHEREAS, subdivisions require a tentative tract map subject to the approval by the
Planning Commission pursuant to Subsection .010 of Section 17.08.100 (Advisory Agency Duties)
of Chapter 17.08 (Subdivisions); and
WHEREAS, pursuant to and in accordance with the provisions of the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as
"CEQA"), the State of California Guidelines for Implementation of the California Environmental
Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA
Guidelines"), the City is the "lead agency" for the preparation and consideration of environmental
documents for the Proposed Project; and
WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on May 4, 2026 at 5:00 p.m., with notice of said public hearing having been
duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures)
of the Code, to hear and consider evidence for and against the Proposed Project and to investigate
and make findings and recommendation in connection therewith; and
WHEREAS, the Planning Commission finds that the effects of the Proposed Project are
Categorically Exempt from the requirements to prepare additional environmental documentation
per CEQA Guidelines, Section 15315 — Minor Land Divisions. The Proposed Project is a request
to subdivide the property into a one -lot map for condominium purposes to allow for future
residential development in an urbanized area and designated for Mixed -Use Medium land uses in
the General Plan which permits residential uses. The proposed subdivision would be in
conformance with the General Plan and applicable development standards, with the exception as
those that are granted under State Density Bonus law. A Historic Resource Assessment was
prepared due to the existing structures' age exceeding 45 years and concluded it does not meet the
criteria for historic designation at both state and local levels. Demolition of existing commercial
structures, ornamental landscaping, and associated parking areas will be required to accommodate
future residential development. Under subsection 18.08.030.150, the Code permits by right single-
family attached development in the C-G Zone on properties with a Residential or Mixed -Use
General Plan land use designation, subject to the permitted uses and development standards of the
applicable implementing zone identified in the General Plan. As such, the future residential
development would be a ministerial project, therefore no further CEQA analysis, documentation,
or environmental determination is required pursuant to Public Resources Code Section
21080(b)(1) as set forth in Section 15268 of the CEQA Guidelines. However, future improvements
will require issuance of construction permits to demonstrate compliance with all applicable State
and City codes, standards, and policies. All services and access to the property would be provided
in accordance with local standards, the property was not involved in the division of a larger parcel
within the previous two years, and the parcel does not have an average slope greater than 20
percent. Pursuant to Sections 15315 and 15300.2 of the CEQA Guidelines, no exceptions to the
exemption apply, there are no unusual circumstances in respect to the Proposed Project that would
cause a significant effect on the environment, and therefore, the Proposed Project is categorically
exempt from the provision of CEQA; and
WHEREAS, the Planning Commission, after due inspection, investigation, and study made
by itself and in its behalf, and after due consideration of all evidence and reports offered at said
hearing with respect to the request to approve Tentative Tract Map No. 19410, does find and
determine the following facts:
1. That the proposed map is consistent with the General Plan. The proposed
subdivision will create a one -lot condominium map to facilitate the sale of individual residential
units. The General Plan designates the site as Mixed -Use Medium, which allows flexibility for
parcels to transition from strip commercial uses to stand-alone residential or a mix of residential,
commercial, and office developments. Future development with single-family attached residential
will be consistent with the permitted uses and intent of the General Plan designation. The project
utilizes provisions of State Density Bonus Law by including three on -site affordable housing units
at the moderate -income level.
2. That the design or improvement of the proposed subdivision is consistent with the
General Plan. The subdivision's design is consistent with the General Plan Mixed -Use Medium
designation. The site is a flat, urban infill parcel with no known environmental or physical
constraints. The site will be adequately served by existing public utilities that include vehicular
access from the major roadways - Anaheim Boulevard and Water Street. The map will be
compatible with surrounding land uses, which include existing residential neighborhoods to the
west of the site.
- 2 - PC2026-011
3. That the site is physically suitable to support future single-family attached
residential development. The site will meet applicable Mixed -Use Zone development standards,
except where incentives and waivers are granted pursuant to State Density Bonus Law, and will
provide adequate vehicular access and public easements necessary to serve the intended residential
development. Furthermore, the surrounding area is developed with similar residential uses, making
the proposed use appropriate and compatible with the area.
4. That the site is physically suitable for the proposed density of development. As a
flat, urban infill site with no environmental or physical constraints, the site will provide a suitable
setting for the intended residential development associated with the tentative tract map with access
to public utilities and vehicular connections. The Mixed -Use Medium General Plan designation
will allow residential development at densities ranging from 18 to 36 dwelling units per gross acre.
Tentative Tract Map No. 19410 is comprised of 1.33-gross acres that will allow development of
30 units at a density of 22 units per acre.
5. That the design of the subdivision or the proposed improvements are not likely to
cause substantial environmental damage or substantially and avoidably injure fish or wildlife or
their habitat. This site is located in an urbanized area and is currently improved with existing
commercial structures, ornamental landscaping, and associated parking areas. There are no known
or observed sensitive environmental habitats on the subject site, and as such, the subdivision is not
likely to cause substantial environmental damage or substantially and avoidably injure fish or
wildlife or their habitat.
6. That the design of the subdivision or type of improvements are not likely to cause
serious public health problems. The subdivision and any future proposed improvements will be
designed to meet all applicable State and City codes, standards, policies, and rules intended to
protect public health.
7. That the design of the subdivision or the type of improvements will not conflict
with easements acquired by the public for access through or use of property within the proposed
subdivision. The subdivision and any future proposed improvements will be designed to provide
all the applicable easements for access through, or use of property within the proposed subdivision,
and would not conflict with any existing or future easements; and
WHEREAS, this Planning Commission determines that the evidence in the record
constitutes substantial evidence to support the actions taken and the findings made in this
Resolution, that the facts stated in this Resolution are supported by substantial evidence in the
record, including testimony received at the public hearing, the staff presentations, the staff report,
and all materials in the project files. There is no substantial evidence, nor are there other facts, that
negate the findings made in this Resolution. This Planning Commission expressly declares that it
considered all evidence presented and reached these findings after due consideration of all
evidence presented to it.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, this
Planning Commission does hereby approve Tentative Tract Map No. 19410, contingent upon and
- 3 - PC2026-011
subject to the conditions of approval set forth in Exhibit B attached hereto and incorporated herein
by this reference, which are hereby found to be a necessary prerequisite to the proposed use of the
Property for which the tentative tract map is applicable in order to preserve the health, safety and
general welfare of the citizens of the City of Anaheim. Extensions for further time to complete
conditions of approval may be granted in accordance with Section 17.08.110 (Expiration of
Tentative Map Approval) of the Code. Timing for compliance with conditions of approval may
be amended by the Planning and Building Director upon a showing of good cause provided (i)
equivalent timing is established that satisfies the original intent and purpose of the condition, (ii)
the modification complies with the Code, and (iii) the applicant has demonstrated significant
progress toward establishment of the use or approved development.
BE IT FURTHER RESOLVED, that any amendment, modification, or revocation of
this permit may be processed in accordance with Chapters 18.60.190 (Amendment of Permit
Approval) and 18.60.200 (Revocation or Modification of Permits) of the Code.
BE IT FURTHER RESOLVED, that the Planning Commission does hereby find and
determine that adoption of this Resolution is expressly predicated upon applicant's compliance
with each and all of the conditions hereinabove set forth. Should any such condition, or any part
thereof, be declared invalid or unenforceable by the final judgment of any court of competent
jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and
void.
BE IT FURTHER RESOLVED, that approval of this application constitutes approval of
the proposed request only to the extent that it complies with the Code and any other applicable City,
State and Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation, or requirement.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
May 4, 2026. Said resolution is subject to the appeal provisions set forth in Chapter 18.60
(Procedures) of the Anaheim Municipal Code pertaining to appeal procedures and may be replaced
by a City Council Resolution in the event of an appeal.

applicable thresholds shall include, but are not limited to, the
mitigation measures recommended by SCAQMD's CEQA Air
Quality Handbook, to the extent feasible and applicable. The
measures shall be included as notes on the grading and/or
demolition plans:
• The area disturbed by clearing, grading, earth moving, or
excavation operations shall be minimized to prevent
excess amounts of dust.
• Pre-grading/excavation activities shall include watering
the area to be graded or excavated before commencement
of grading or excavation operations. Application of
watering (preferably reclaimed, if available) should
penetrate sufficiently to minimize fugitive dust during
grading activities. This measure can achieve PM10
reductions of 61 percent through application of water
every three hours to disturbed areas.
• Fugitive dust produced during grading, excavation, and
construction activities shall be controlled by the
following activities:
o All trucks shall be required to cover their loads as
required by California Vehicle Section 23114.
Covering loads and maintaining a freeboard
height of 12 inches can reduce PM10 emissions
by 91 percent.
o All graded and excavated material, exposed soil
areas, and active portions of the construction site,
including unpaved on -site roadways, shall be
treated to prevent fugitive dust. Treatment shall
include, but not necessarily be limited to, periodic
watering, application of environmentally safe soil

three hours to disturbed areas can reduce PM10
emissions by 61 percent.
• Graded and/or excavated inactive areas of the
construction site shall be monitored at least weekly for
dust stabilization. Soil stabilization methods, such as
water and roll -compaction, and environmentally safe
dust control materials, shall be periodically applied to
portions of the construction site that are inactive for over
four days. If no further grading or excavation operations
are planned for the area, the area should be seeded and
watered until grass growth is evident, or periodically
treated with environmentally safe dust suppressants, to
prevent excessive fugitive dust. Replacement of ground
cover in disturbed areas can reduce PM10 emissions by
5 percent.
• Signs shall be posted on -site limiting traffic to 15 miles
per hour or less. This measure can reduce associated
PM10 emissions by 57 percent.
• During periods of high winds (i.e., wind speed sufficient
to cause fugitive dust to impact adjacent properties), all
clearing, grading, earth -moving, and excavation
operations shall be curtailed to the degree necessary to
prevent fugitive dust created by on -site activities and
operations from being a nuisance or hazard off -site or on -
site. The site superintendent/supervisor shall use his/her
discretion in conjunction with SCAQMD when winds are
excessive.
• Adjacent streets and roads shall be swept at least once per
day, preferably at the end of the day, if visible soil
material is carried over to adjacent streets and roads.
Personnel involved in grading operations, including contractors
and subcontractors, should be advised to wear respiratory
protection in accordance with California Division of

activities substantially disrupted, the Biologist shall delineate an
appropriate no -impact buffer zone (at a minimum of 25 feet)
around the nest depending on the sensitivity of the species and
the nature of the construction activity. All nests and associated
buffers shall be mapped on the construction plans. The active
nest shall be protected until nesting activity has ended. The
following restrictions to clearing and/or construction activities
shall be required until nest(s) are no longer active, as determined
by a qualified Biologist: (1) clearing limits shall be established
within a buffer around any occupied nest (the buffer shall be 25
to 100 feet for nesting birds and 300 to 500 feet for nesting
raptors), unless otherwise determined by a qualified Biologist;
and (2) access shall be restricted within the buffer of any active
nest, unless otherwise determined by a qualified Biologist.
Encroachment into the buffer area around a known nest shall
only be allowed if the Biologist determines that the proposed
activity would not disturb the nest occupants. Once the qualified
Biologist has determined that fledglings have left the nest, there
is no evidence of a second nesting attempt, or the nest has failed,
the Biologist's findings shall be submitted to the Planning and
