Resolution-PC2026-016RESOLUTION NO. PC2026-016 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ANAHEIM APPROVING TENTATIVE PARCEL MAP NO. 2026- 105 TO SUBDIVIDE AN EXISTING INDUSTRIAL PROPERTY INTO ONE LOT FOR CONDOMINIUM PURPOSES TO CREATE THIRTEEN AIRSPACE UNITS AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH (DEV2026-00009) (1188 NORTH GROVE STREET) WHEREAS, the Planning Commission of the City of Anaheim (the "Planning Commission") did receive a verified petition to approve Tentative Parcel Map No. 2026-105 to subdivide an existing industrial property into one lot for condominium purposes to create 13 airspace units (the "Proposed Project") on certain real property located at 1188 North Grove Street in the City of Anaheim, County of Orange, State of California, as generally depicted on Exhibit A attached hereto and incorporated herein by this reference (the "Property"); and WHEREAS, the Property is approximately 1.16 acres (50,470 square feet) in area and is developed with a single -story, 17,225 square -foot industrial building, surface parking, site landscaping, and trash enclosure. The Property is designated for Industrial land uses in the General Plan. The Property is in the Anaheim Canyon Specific Plan No. 2015-1, Development Area 1 (DA- 1: Industrial Area) and is subject to the zoning and development standards contained in Chapter 18.120 (Anaheim Canyon Specific Plan No. 2015-1 (SP 2015-1) Zoning and Development Standards) of the Anaheim Municipal Code (the "Code"); and WHEREAS, subdivisions require a tentative parcel map subject to the approval by the Planning Commission pursuant to Subsection .010 of Section 17.08.100 (Advisory Agency Duties) of Chapter 17.08 (Subdivisions); and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as "CEQA"), the State of California Guidelines for Implementation of the California Environmental Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 29, 2026, at 5:00 p.m., with notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) and Section .095 (Notice and Hearing) of Chapter 17.08 (Subdivisions) of the Code, to hear and consider evidence for and against the Proposed Project and to investigate and make findings and recommendation in connection therewith; and WHEREAS, the Planning Commission finds that the effects of the Proposed Project are Categorically Exempt from the requirements to prepare additional environmental documentation per CEQA Guidelines, Section 15301 — Existing Facilities and Section 15315 — Minor Land Divisions Categorical Exemption. The Proposed Project is a request to subdivide an existing industrial building, permitting a one -lot subdivision to create 13 airspace condominium units and relocation of an existing trash enclosure, and operations will remain consistent with historic levels of operation on the subject property. The Property is in an urbanized area zoned for industrial uses, results in a one -lot subdivision for 13 airspace condominium units, is in conformance with the General Plan and zoning, does not require any deviations, will continue to provide access to services, and does not involve a parcel involved in a land division within the previous two years or have a slope average greater than 20 percent. Pursuant to Sections 15301, 15315, and 15300.2 of the CEQA Guidelines, no exceptions to the exemption apply, there are no unusual circumstances in respect to the Proposed Project that would cause a significant effect on the environment and, therefore, the Proposed Project is categorically exempt from the provisions of CEQA; and WHEREAS, the Planning Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for a Tentative Parcel Map No. 2026-105, does find and determine the following facts: 1. That the proposed map is consistent with the General Plan because the subject property is developed with an existing legally established industrial building that has historically been occupied by industrial uses consistent with the site's Industrial General Plan land use designation. The proposed subdivision will allow for condominium ownership and individual airspace units within the existing building and will not result in any changes to the approved industrial uses or introduce land uses that conflict with the General Plan designation. 2. That the design or improvement of the proposed subdivision is consistent with the General Plan because the proposed subdivision will not substantially alter the existing development, which consists of an industrial building and associated site improvements that are consistent with the Industrial General Plan land use designation. Aside from relocating the existing trash enclosure to improve site functionality and screening, no significant physical modifications will be proposed. The proposed subdivision will allow condominium ownership and individual airspace units within the existing building while maintaining the site's existing industrial character and therefore will continue to be compatible with surrounding industrial development. 3. That the site is physically suitable for the type of development as the property is currently developed with an existing industrial building, surface parking, landscaping, and associated site improvements that adequately accommodate the existing industrial uses and conform to applicable development standards. The proposed subdivision will not result in an expansion or intensification of development on the site, but will instead establish condominium ownership and individual airspace units within the existing building. In addition, relocating the existing trash enclosure will improve site functionality and conformance with City standards while maintaining adequate site circulation. - 2 - PC2026-016 4. That the site is physically suitable for the proposed density of development as the proposed subdivision will not result in an expansion of the existing development or an increase in building floor area. The project involves the subdivision of an existing 17,225 square -foot industrial building on a 50,470 square -foot site, resulting in a floor area ratio (FAR) of 0.34, which is below the maximum FAR of 0.50 permitted by the General Plan. Furthermore, all existing and proposed improvements associated with the development will be contained within the boundaries of the subject property. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat as the subject property is a fully developed industrial site containing an existing industrial building, surface parking, landscaping, and other associated site improvements that will remain unchanged. The proposed subdivision will establish condominium ownership and individual airspace units corresponding to the existing tenant spaces and will not result in any expansion or substantial modification of the site. In addition, the site does not contain sensitive habitat or other natural resources that could be adversely affected by the proposed subdivision. 6. That the design of the subdivision or type of improvements are not likely to cause serious public health problems because the proposed subdivision will not alter the existing character or operation of the site, nor will it introduce new land uses or activities that could result in harmful public health impacts. The legally established industrial use will continue to operate in a manner consistent with its historical industrial use and in accordance with applicable zoning regulations. Physical improvements will be limited to relocating the existing trash enclosure, which will improve site functionality and screening and will not result in conditions detrimental to public health. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision because the proposed subdivision will not modify existing access, circulation, or easement areas on the site. Existing site improvements will remain substantially unchanged, except for the relocation of the trash enclosure, which will not interfere with public access or the use of any existing easements. The proposed subdivision will maintain existing access and circulation throughout the site and will not obstruct or impair the use of any public easements; and WHEREAS, this Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report, and all materials in the project files.
