Resolution-PC2026-021RESOLUTION NO. PC2026-021 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 2017-05927 TO ALLOW PUBLIC ACCESS TO THE HOTEL ROOFTOP RESTAURANT/BAR AND ADMINISTRATIVE ADJUSTMENT TO PERMIT FEWER PARKING SPACES THAN REQUIRED BY THE CODE AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH (DEV2026-00029) (1601 SOUTH ANAHEIM BOULEVARD) WHEREAS, the Planning Commission of the City of Anaheim (the "Planning Commission") did receive a verified petition to amend to Conditional Use Permit No. 2017-05927 to allow public access to The Viv Hotel rooftop restaurant/bar and an administrative adjustment to permit fewer parking spaces than required by the Anaheim Municipal Code (the "Code") (collectively, the "Proposed Project") on certain real property located at 1601 South Anaheim Boulevard in the City of Anaheim, County of Orange, State of California, as generally depicted on Exhibit A attached hereto and incorporated herein by this reference (the "Property"); and WHEREAS, the Property is approximately 3.18 acres in area and is developed with an existing 12-story, 326-room hotel and a four -level, 347-space parking structure. The Property is designated for General Commercial land uses in the General Plan and is located in the "C-G" General Commercial Zone and the Regional Commercial District of the South Anaheim Boulevard Corridor (" SABC") Overlay Zone, subject to the development standards and regulations set forth in Chapter 18.08 (Commercial Zones) and Chapter 18.24 (South Anaheim Boulevard Corridor Overlay Zone) of the Code; however, pursuant to Chapter 18.24, the provisions of the SABC Overlay Zone do not apply to parcels developed entirely under the "C-G" Zone, as is the case with the existing development; and WHEREAS, on April 30, 2018, the Planning Commission adopted Resolution No. PC2018- 026, approving Conditional Use Permit No. 2017-05927 (DEV2017-00035) to allow the development of a 12-story, 326-room hotel and four -level, 347-space parking structure at a greater floor area ratio and building height than permitted by the Code, and Variance No. 2018-05106 for fewer trees along the Santa Ana Freeway (I-5); and WHEREAS, a Mitigated Negative Declaration was prepared to evaluate the environmental impacts of the project (DEV2017-00035) in accordance with the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, and the Planning Commission adopted Mitigation Monitoring Plan No. 352 by Resolution No. PC2018-025; and WHEREAS, the hotel was subsequently developed and currently operates as The Viv Hotel and includes a restaurant/bar located on the rooftop of the hotel. Conditions of approval imposed in connection with Conditional Use Permit No. 2017-05927 limit access to the rooftop restaurant/bar to registered hotel guests; and WHEREAS, the original approval was subject to mitigation measures incorporated into Resolution No. PC2018-026 as conditions of approval pursuant to the applicable environmental review. The mitigation measures were applicable to grading and construction activities associated with the original project and have been fully implemented and satisfied. The mitigation measures did not impose continuing operational requirements and are not applicable to the modifications approved by this resolution. Accordingly, the mitigation measures are not included as conditions of approval of this amendment. WHEREAS, amendments to the conditions of approval imposed in connection with Conditional Use Permit No. 2017-05927 adopted by Resolution No. PC2018-026, are considered a major amendment to the conditional use permit, subject to approval by the Planning Commission pursuant to Subsection .030 of Section 18.60.190 (Amendment of Permit Approval). The Proposed Project does not include an amendment to Variance No. 2018-05106; and WHEREAS, Section 18.60.080 (Planning Director Reviews) of Chapter 18.60 (Procedures) of the Code provides that, when an application is made in conjunction with, and as part of, a project that requires Planning Commission action, the application shall be made to the Planning Commission in accordance with Chapter 18.60, and because the Proposed Project includes a major amendment to the conditional use permit that requires Planning Commission action, the administrative adjustment for parking is being processed concurrently before the Planning Commission as the granting authority; and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as "CEQA"), the State of California Guidelines for Implementation of the California Environmental Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 21, 2026 at 5:00 p.m., with notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) of the Code, to hear and consider evidence for and against the Proposed Project and to investigate and make findings and recommendation in connection therewith; and WHEREAS, the Planning Commission finds that the effects of the Proposed Project are Categorically Exempt from the requirements to prepare additional environmental documentation per CEQA Guidelines, Section 15301 — Existing Facilities. The Class 1 Exemption consists of the operation, repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of existing or former use, where no physical changes occur which are not otherwise exempt. The Proposed Project is a request to amend a conditional use permit for an existing hotel to allow public access to the rooftop restaurant/bar and to permit fewer parking spaces than required by the Code. The amendment would not result in physical expansion of the existing hotel or rooftop restaurant/bar and would formalize an existing operational condition in which the rooftop restaurant/bar is serving members of the public. The proposed modifications would remain consistent with the historic level of operations on the subject property and would therefore be - 2 - PC2026-021 consistent with this type of exemption. Pursuant to Sections 15301 and 15300.2 of the CEQA Guidelines, no exceptions to the exemption apply, there are no unusual circumstances in respect to the Proposed Project that would cause a significant effect on the environment and, therefore, the Proposed Project is categorically exempt from the provisions of CEQA; and WHEREAS, the Planning Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for a conditional use permit amendment, does find and determine the following facts: 1. The proposed amendment to the conditions of approval for an existing hotel is properly one that will serve a use for which a conditional use permit is authorized within the General Commercial Zone under Subsection .040 of Section 18.08.030 (Uses) of Chapter 18.08 (Commercial Zones) of the Code. 2. The proposed amendments will not adversely affect the adjoining land uses, or the growth and development of the area in which it is proposed to be located, as they will formalize the existing operations of an established hotel by allowing public access to the existing rooftop restaurant/bar. The amendment to the conditional use permit will not expand the existing building footprint, increase restaurant seating capacity, or otherwise alter the physical development of the site. The hotel has historically operated in conjunction with the surrounding land uses, and the proposed modification will allow the existing hotel and restaurant/bar to continue operating in a manner that will not adversely affect adjoining properties or the continued growth and development of the surrounding area. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner that will not be detrimental to the surrounding area or public health and safety, as the hotel and rooftop restaurant/bar already exist. The proposed amendment will not expand the existing building footprint or restaurant/bar seating capacity; rather, it will formalize the existing public access to the restaurant/bar. The hotel will continue to provide on -site security and maintain measures to ensure the safety of hotel guests and restaurant customers, and the Proposed Project is conditioned restrict access to the rooftop pool area and guestroom levels to registered hotel guests through a key card access system or other controlled -access system deemed appropriate. Additionally, a parking study was prepared to evaluate whether the existing parking supply is adequate to accommodate the peak parking demand associated with the hotel and rooftop restaurant/bar. The parking surveys were conducted while the hotel and rooftop restaurant/bar were reasonably occupied and were representative of peak conditions. The analysis identified an observed peak parking demand of 276 occupied parking spaces with 347 parking spaces provided, demonstrating that the existing parking supply is adequate to accommodate the demand associated with the proposed amendment. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry traffic in the area. The hotel and restaurant/bar are existing uses, and although the conditions of approval limit access to the restaurant/bar to hotel - 3 - PC2026-021 guests, the restaurant/bar has been in operation and serving members of the public. The proposed amendment will permit this existing practice and will not introduce a new use, expand the restaurant/bar or seating capacity, or substantially intensify operations on the site. The surrounding street and highway network currently accommodates the existing traffic associated with the hotel and restaurant/bar; therefore, approval of the amendment is not expected to substantially increase traffic volumes in the area. 5. The granting of the amendment to the conditional use permit under the conditions imposed will not be detrimental to the health and safety of the citizens of the City of Anaheim because the request will remove the operational limitations of an existing hotel to allow members of the public to access the existing rooftop restaurant/bar. The amendment will not introduce a new use or potentially harmful activity at the site; rather, it will allow the existing rooftop restaurant/bar to continue operating as an amenity serving hotel guests and members of the public. The restaurant/bar will continue operating within the existing facility and remain subject to the applicable conditions of approval and City requirements intended to protect public health and safety; and WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for administrative adjustment, does find and determine the following facts: SECTION 18.62.040.020.0202.01 Minimum Number of Parking Spaces (394 spaces required; 347 spaces proposed) 1. The adjustment is consistent with the purposes and intent of the Zoning Code because the reduced parking requirement will continue to provide adequate parking to accommodate the parking demand generated by the site. Although allowing the restaurant/bar to serve members of the public will require additional Code -required parking, the parking study demonstrates that the parking demand generated by the existing hotel and rooftop restaurant/bar operations will remain below the number of parking spaces available on -site. The site will provide 347 parking spaces, resulting in a Code -required parking deficiency of 47 spaces, or a 12% reduction, which is below the allowed 20% parking requirement deviation. While the requested adjustment will allow a reduction from the Code - required parking, an adequate parking supply to serve the existing hotel and rooftop restaurant/bar operations will be maintained; 2. The same or similar result cannot be achieved by using provisions in the Zoning Code that do not require the adjustment. The site is fully developed with an existing hotel, restaurant/bar, parking structure, and associated improvements with no available area for expansion. Complying with the applicable parking requirement will require adding 47 parking spaces. Given the existing development and site configuration, accommodating the additional required parking will require substantial site modifications or removal of existing improvements. Therefore, there are no other provisions of the Code that will achieve the same or similar result without the requested adjustment; 3. The adjustment will not produce a result that is out of character or detrimental to the neighborhood because the existing operations will be consistent with the existing day-to-day operations of the restaurant/bar and the visitor -serving nature of a hotel property. The property is fully developed with an existing hotel and rooftop restaurant/bar that already serves hotel guests and - 4 - PC2026-021 visitors in the area. Formalizing the restaurant/bar to serve the public will not alter the site's physical character or change how the restaurant operates. Restaurant customers, whether hotel guests or members of the public, will use the same existing facilities and amenities and will be subject to the restaurant's existing seating capacity and operational limitations. The adjustment will not increase the restaurant's overall capacity or introduce an activity that is incompatible with the existing property or surrounding neighborhood. Lastly, Condition of Approval No. 19 will ensure the owner and operator will monitor on -site parking and establish a Parking Management Plan if future problems arise. WHEREAS, this Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report, and all materials in the project files. BE IT FURTHER RESOLVED, that any amendment, modification, or revocation of this permit may be processed in accordance with Sections 18.60.190 (Amendment of Permit Approval) and 18.60.200 (Revocation or Modification of Permits) of the Code. BE IT FURTHER RESOLVED, that the Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. - 5 - PC2026-021 BE IT FURTHER RESOLVED, that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Code and any other applicable City, State and Federal regulations.
