A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 1007
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
from MR. and MRS. WAYNE R. JONES, 2229 East Lincoln Avenue, Anaheim,
California, to use an existing residential structure, located on
the property hereinafter described, for professional offices. That
said property is situated in the City of Anaheim, County of Orange,
State of California, and is more particularly described as follows:
That portion of the Northwest quarter of the Southwest
quarter and the Southwest quarter of the Northwest
quarter of Section 12, Township 4 South, Range 10 West,
in the Rancho San Juan Canon De Santa Ana, in the City
of Anaheim, as shown on a map recorded in Book 51, page
10, Miscellaneous Maps, records of said Orange County,
described as follows:
Beginning at a point being on the South line of Tract
No. 1843, as shown on the map recorded in Book 53, pages
45 and 46, Miscellaneous Maps, records of said Orange
County, distant North 89° 51' 35" East 171.57 feet from
the Northeast corner of Lot 1 of said Tract 1843; thence
North 89° 51' 35" East along the South line of said
Tract 1843 96.40 feet to the East line of the Southwest
quarter of the Northwest quarter of said Section 12, as
said East line is shown on a licensed surveyor's map
recorded in Book 28, page 26 of Record of Surveys of
said Orange County; thence South 0° 10' 40" West 20.00
feet to the Southeast corner of the Southwest quarter
of the Northwest quarter of said Section 12; thence
South 0° 09' 55" West along the East line of the North-
west quarter of the Southwest quarter of said Section 12,
267.22 feet to the center line of Anaheim -Olive Road, as
shown on said map of Tract 1843; thence North 78° 52' 26
West along said center line, 98.19 feet to an intersection
with a line which bears South 0° 09' 55" West from the
point of beginning; thence North 0° 09' 55" East 268.03
feet to the point of beginning.
EXCEPTING public street dedications of record.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on March 11 1968 notices of
which said public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. PC68 -63

WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in denying said conditional use
permit and did thereupon fix the 9th day of April
19 as the time and the Council Chamber in the City Hall
o t e City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental the
particular area nor to the peace, health, safety
and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission denying said conditional use permit be, and
the same is hereby disapproved and that Conditional Use
Permit No. 1007 be, and the same is hereby, granted
permitting an existing residential structure, located on the
property hereinbefore described, to be used for professional
offices subject to the following conditions:
1. That all access to Lincoln Avenue shall be approved
by the City Engineer.
2. That trash storage areas shall be provided in accor-
dance with approved plans on file in the Office of
the Director of Public Works and Superintendent of
Streets.

3. That all air conditioning facilities shall be
properly shielded from view, and the sound buffered
from adjacent residential homes.
4. That the structure shall be brought up to the mini-
mum standards of the Uniform Building, Plumbing, and
Electrical Codes, as adopted by the City of Anaheim,
for commercial structures.
5. That the parking areas shall be lighted with down
lighting, of a maximum height of six feet, which shall
be directed away from the property lines to protect
the residential integrity of the area.
6. That Conditions Nos. 1, 2, 3, 4 and 5, above mentioned,
shall be complied with prior to final building and
zoning inspections.
7. That all vehicular access rights to the alley north
of subject property shall be dedicated to the City
of Anaheim.
8. That a six -foot masonry wall shall be constructed
along the north and west property lines of subject
property, with a temporary waiver of the wall require-
ment along the west boundary, said wall to be con-
structed upon demand of the City of Anaheim.
9. That this conditional use permit is granted subject
to the completion of Reclassification Proceedings
No. 67 -68 -59 now pending.
The City Council hereby reserves the right to revoke
such conditional use permit for good cause or failure of said
owners, their heirs, successors or assigns to comply with
the Anaheim Municipal Code and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
