A RESOLUTION OF THE CITY COUJCIL OF THE CITY
OF ANAHEIM ORDERING THE VACATION AND ABANDON-
MENT OF A CERTAIN PUBLIC SERVICE EASEMENT.
WHEREAS, the City Council of the City of Anaheim has
elected to proceed pursuant to the provisions of the Public
Services Easements Vacation Law (Section 50430 et seq. Government
Code) in connection with the vacation and abandonment of public
service easements; and
WHEREAS, the City Council did, by resolution duly posted
and published, give notice of its intention to abandon the follow
ing described public service easement (hereinafter "Easement
to wit:
That portion of an existing public utility easement
including but not limited to water transmission and
distribution lines, sanitary sewer lines and storm
drains as reserved and described in Resolution No.
69R -351 recorded June 23, 1969 in Book 8998, pages
405, 406 and 407, Official Records, located in the
City of Anaheim, County of Orange, State of Califor-
nia, described as follows:
PARCEL ONE: The southerly 13 feet of that portion
of former Vermont Avenue (66 feet wide) formerly
known as Broad Street lying northerly of and adja-
cent to Lot 29 of the Anaheim Extension as shown on
a map of Survey made by William Hamel and filed in
the office of the County Recorder of Los Angeles
County, a copy of which is shown in Book 3, page 163,
et seq., entitled Los Angeles County Maps, records
of said Orange County.
PARCEL TWO: Air rights only to be abandoned commenc-
ing at a point 158 feet above sea level over the
following described parcel:
The northerly 5 feet of the southerly 18 feet of
that portion of former Vermont Avenue (66 feet wide)
formerly known as Broad Street lying northerly and
adjacent to Lot 29 of the Anaheim Extension, as shown
on a map of Survey made by William Hamel and filed in
the office of the County Recorder of Los Angeles
County, a copy of which is shown in Book 3, page 163,
et sea., entitled Los Angeles County Maps, records of
said Orange County; and
WHEREAS, on the 27th day of February, 1979, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed abandonment; and
WHEREAS, the City Council of the City of Anaheim does find
from the evidence submitted to it, that said Easement is unnecessary
for present or prospective public use.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation and abandonment
of said Easement.
AND BE IT FURTHER RESOLVED that the City Clerk be, and
she is hereby, authorized and directed to cause a certified copy
of this Resolution and Order, attested by her under the seal of
the City of Anaheim to be recorded in the Office of the County Re-
corder of Orange County, California.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 27th day of February,
1979.
