1979-114RESOLUTION NO. 79R -114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEI'I DETERI INI THAT CERTAIN PUBLIC ALLEYS SHOULD BE ABANDONED AND ESTABLISHING CONDITIONS PRECEDENT TO SAID ABANDONMENT. WHEREAS, the City Council of the Ctiy of Anaheim has elected to proceed under the provisions of the Street Vacation Act of 1941 (Section 8300 et seq., Streets and Highways Code) in connection with requests for vacation and abandonment of public streets within the City of Anaheim; and WHEREAS, the City Council did, by resolution duly posted and published, give notice of its intention to abandon the follow- ing described alleys; to wit, those public alleys in the block bounded by Harbor Boulevard, Chartres Street, Lincoln Avenue and Helena Street more specifically described as follows: Those certain public alleys located in the City of Anaheim, County of Orange, State of California, lying between Lincoln Avenue on the south and Chartres Street on the north, Harbor Boulevard on the west and Helena Street on the east, described as follows: Beginning at the northwest corner of Lot 19 of the Subdivision of Vineyard Lot D -5, as shown on a map recorded in Book 1, pages 135 through 157, yTiscel- laneous Records of Los Angeles County; thence South- erly 184 feet along the west lines of Lots 19, 20, 21 and 22 to the southwest corner of said Lot 22; thence Easterly 157 feet along the southerly line of said Lot 22 to the southeast corner thereof; thence South- erly 16 feet to an intersection with a line parallel with and 16 feet southerly of the south line of said Lot 22; thence Westerly along said parallel line a distance of 110 feet to an intersection with the east- erly line of Lot 28 of said Subdivision of Vineyard Lot D -5; thence Southerly 2 feet along: the easterly line of said Lot 28 to an intersection with a line parallel with and 2 feet southerly of the northerly line of said Lot 28; thence Westerly 75 feet along the last mentioned parallel line to an intersection with the easterly line of Lot 25; thence Northerly 2 feet along the easterly line of said Lot 25 to the northerly line of said Lot 25; thence Westerly 104.50 feet along the northerly line of said Lot 25 and the northerly line of Lots 23 and 24 and the westerly pro- longation thereof to an intersection with a line paral- lel with and 75.25 feet easterly of the centerline of Harbor Boulevard; thence Northerly 16 feet along the last mentioned parallel line to an intersection with the southerly line of Lot 18 of said Resubdivision of Vineyard Lot D -5; thence Easterly 96.50 feet along the southerly line of said Lot 18 to the southeast corner thereof; thence Northerly 92 feet along the easterly line of said Lot 18 and the easterly lines of Lot 17 to an intersection with the southerly line of Lot 16 of said Resubdivision; thence Westerly 2 feet along the south line of said Lot 16 to an intersection with a line parallel with and 10 feet westerly of the center- line of the alley adjoining; said Lot 16 to the east; thence Northerly 46 feet along the last mentioned par- allel line to an intersection with the southerly line of Lot 15 of said Resubdivision; thence Easterly 2 feet along the south line of said Lot 15 to an intersection with a line parallel with and 8 feet westerly of the centerline of the last mentioned alley; thence North- erly 46 feet along the last mentioned parallel line to an intersection with the north line of said Lot 15; thence Easterly 16 feet along a line parallel with and 26.25 feet southerly of the centerline of Chartres Street to the point of beginning; and WHEREAS, on the 27th day of February, 1979, a public hear ing was held to allow interested persons to submit evidence concern- ing said proposed abandonment; and WHEREAS, the City Council of the City of Anaheim does find from the evidence submitted to it that said alleys are un- necessary for present or prospective public use; and WHEREAS, the City Council has further determined that certain conditions must be met prior to making of an order vacating and abandoning said alleys. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does determine that said alleys should be abandoned and vacated subject to the following condition: That said alleys be abandoned at such time as all private property users adjacent to said alleys have been relocated. BE IT FURTHER RESOLVED that should the condition set forth in the preceding Paragraph be fulfilled within one hundred eighty (180) days of the date of this Resolution, the City Council will make its order vacating and abandoning said alleys. BE IT FURTHER RESOLVED that should said condition not be fulfilled within said one hundred eighty (180) days or such furtner time as the City Council may grant, then this Resolution shall ter- minate, and resort shall be had to a new and separate proceeding. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 27th day of February, 1979.
