Anaheim owns and operates the public facility known as the Brookhurst Community Center; and WHEREAS, it is desirable to establish a City policy re- lating to the use of alcoholic beverages on said. premises. NOIi THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that that certain Policy attached hereto, marked Exhibit "A," and incorporated herein by this reference as if set forth in full is hereby adopted as the alcoholic beverage use policy for the Brookhurst Community Center. PHILOSOPHY: The Parks, Recreation and Community Services Department believes the use of wine and champagne only at Brookhurst Community Center will allow more varied use of the Center and provide a service to many groups who desire to use the Center for various social functions. However, the Department wishes to insure that the use of alcohol at Brookhurst Community Center will not infringe upon other citizens use of the facility in pursuit of leisure time activities. THE LAW: In accordance with the State Penal Code no person under 21 years of age is permitted the use of alcoholic beverages and being intoxicated in public is considered disorderly conduct and a misdemeanor. LIABILITY: Proof of liability insurance may be required from an applicant whenever the Department deems it necessary. The applicant, under this circumstance, will be required to procure, pay for, and maintain in full force and effect a Comprehensive Personal Liability and Property Damage Insurance Policy in amounts of not less than $250,000 for any one person in any single accident, $500,000 for injuries to more than one person and $100,000 for property damage. It is further understood and agreed that the City of Anaheim, its officials, officers and employees are additionally insured with regard to and solely in regard to, the use of property owned by the City of Anaheim by the applicant. Also, policy must include a ten (10) day cancellation notice. The policy must be deposited with the Department five (5) days prior to the applicants use of the facility before final approval will be given. TYPE OF ALCOHOL ALLOWED: The alcohol that may be served is restricted to wine and champagne only. LOCATION: Wine and champagne may be consumed or served only within the specific room or rooms for which the applicant has an approved application. Wine and champagne may not be served or consumed outside of the approved area including: the lobby, parking lot or surrounding park area. EXHIBIT "A" ALCOHOL USE POLICY PAGE 2 LIMIT ON AMOUNT OF TIME ALCOHOL MAY BE SERVED: Wine and champagne may only be consumed or served within a four (4) hour period per daily use by any one group or organization. Alcohol may not be served after 12 midnight. SECURITY: When in the opinion of the Department Director or Police Department it is considered necessary, the assignment of one or more police officers may be required. The cost of such shall be borne by the applicant and the amount charged shall be at normal prevailing rates per hour, per assignee. It is the applicants responsibility to make the necessary arrangements with the Anaheim Police Department. SALE OF WINE AND CHAMPAGNE: Wine and champagne may be sold only if the applicant has obtained an Alcoholic Beverage Control License. This license must be filed by the applicant with the Brookhurst Community Center Director before the reservation can be finalized. The license must be in possession of the applicant the entire time wine and /or champagne is being sold. FEES AND DEPOSITS: When wine and /or champagne is being served as part of an activity, fees are charged on an hourly basis as follows: Group I II (Anaheim based groups) Group III (Non- resident commercial use) EVENT WORKER: Multi- Purpose East Multi- West Multi Rm. Rooms (Per room) $25.00 $10.00 $50.00 $35.00 An event worker shall be assigned to assist the user when either section of the multi- purpose room is being used and wine and /or champagne is being served. The cost of this worker shall be borne by the user at a rate of $5.00 per hour. This fee is in addition to the room rental fee.
