A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEI:1 GRANTING VARIANCE NO. 3060
WHEREAS, after a request for variance by ROBBIE KAUFMAN
AND JAMES NORMAN MORGAN, owners, was received, a public hearing
before the Planning Commission of the City of Anaheim was held
upon due and proper notice as a result of which Variance No. 3060
was granted covering the following described property:
Beginning at the Northwesterly corner of block 8
of a replat of the Orchard Park Tract, as shown
on a Man recorded in Book 7, page 6 of
Miscellaneous Maps, records of Orange County,
California; thence Easterly along the Northerly
line of said Block, 249.75 feet; thence Southerly
parallel to the Westerly line of said Block 3,
229.5 feet; thence Westerly parallel with the
Northerly line of said. Block, 249.75 feet to the
Westerly line of said Block; thence Northerly
along the Westerly line of said Block S 229.5
feet to the place of beginning.
Excepting therefrom the Northerly 30 feet of
said land as conveyed to the City of Anaheim,
a Municipal corporation, for road and incidental
purposes, by an instrument dated October 11, 1912
and recorded December 9, 1912 in Book 2.24, page
110 of Deeds.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law, and as
a result thereof, the City Council does hereby make the following
findings:
1. That there are special circumstances applicable to the
property, including size, shape, topography, location or
surroundings, which do not apply to other property under identical
zoning classification in the vicinity.
2. That, because of special circumstances shown in (1)
above, strict application of the zoning code deprives the
property of privileges enjoyed by other property under identical
zoning classification in the vicinity.

of the City of Anaheim, that a conditional zoning. variance be,
and the same is hereby granted, permitting the construction
of a three -story office building, and parking lot on the property
hereinbefore described with waivers of the following sections of
the Anaheim Municipal Code:
SECTION 18.06.060. 0213 Minimum number of narking
spaces.
(70 required; 18 proposed)
SECTION 18.41.060.040 Minimum site area.
(20,000 sauare feet required;
18,753 sauare feet proposed)
SECTION 18.41.062.011 Maximum building height.
(8 -1/4 feet permitted;
34 feet proposed)
SECTION 18.
Required site screening.
(6 -foot block_ wall required
adjacent to a residential
zone boundary; none proposed)
That said variance be granted subject to the following conditions:
1. That this variance is granted subject to the completion
of Reclassification No. 65 66 63, now pending.
7 That the owner(s) of subject property shall nay the
traffic signal assessment fee amounting to ;180.00 per 1,000
sauare feet of office building or fraction thereof prior to the
issuance of a building permit, per. City Council Resolution
No. 79R -12.
3. That a mutual narking and access agreement providing
for circulation and parking from one parcel to the other shall
be submitted to the City Attorney's Office for review and
approval; then be filed and recorded in the office of the Orange
County Recorder.
4. That subject property shall be developed substantially
in accordance with plans and specifications on file with the
City of Anaheim marked Exhibit Los. 1 through 3.
5. That Condition 4os. 1 and 3, above mentioned, shall
be complied with prior to the commencement of the activity
authorized under this resolution, or prior to the time that
the building permit is issued, or within a period of one year
from date hereof, whichever occurs first, or such further time
as the City Council may grant.
0. That Condition io. 1 4, above- mentioned, shall be comnlied
with prior to final building and: Bonin' inspections.
BE IT FURTHER RESOLYUD that the City Council hereby
reserves the right to revoke such variance Permit for rood cause
or failure of said owners, their heirs, successors or assigns
to conply with the Anaheim 1unicipal Code and regulations and
the conditions herein. Said variance is ranted for the term
prescribed by the Anaheim Municipal Code unless otherwise
specified herein.
THE FOREGOIEG RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 2nd day of
January, 1979.
