90-070 RESOLUTION NO. 90R-70
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN
CONDITIONS OF APPROVAL IN VARIANCE NO. 3908
AND AlqENDING RESOLUTION NO. 89R-286.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 89R-286 approving Variance No.
3908, subject to certain conditions specified therein; and
WHEREAS, the permittee has now requested an amendment to
certain of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on February 2?, 1990, at which hearing the City Council
did receive and consider evidence, both oral and documentary,
relating to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the
public peace, health, safety or general welfare, or necessary to
permit reasonable operation under said Variance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Variance No. 3908 be, and the same are hereby, amended by the
amendment of Conditions Nos. 1 and 9 as set forth in Resolution
No. 89R-286 to read as follows:
"1. That damaged sidewalks shall be repaired along
Katella Avenue if required by the City Engineer (in
accordance with standard plans and specifications on
file in the Office of the City Engineer) based upon a
field inspection by the City Engineer or his
representative to determine whether repairs are needed
for public health or safety purposes. Foliowing the
inspection, the City Engineer shall notify the
petitioner to make such repairs, if any, as are
necessary in the opinion of the City Engineer to
correct conditions detrimental to the public health or
~safety. Said repairs, shall be commenced and
completed by the petitioner within the times as
specified by the City Engineer."
"9. This Variance shall expire and terminate on March
31, 1991."
VAR 5908 AMD 89R-286
BE IT FURTHER RESOLVED that Condition No. 2 of Variance
No. 3908 as set forth in Resolution No. 89R-286 be, and the same
is hereby, deleted in its entirety.
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolution No. 89R-286 shall remain in full force and
effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 27th day of February,
1990.
