A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEI1Mi AUTHORIZING AND DIRECTING THAT AN
APPLICATION BE FILED WITH THE NUCLEAR REGULA-
TORY COMMISSION SEEKING TO OBTAIN PERMISSION
FOR SOUTHERN CALIFORNIA EDISON COMPANY TO
TRANSFER A PARTIAL OWNERSHIP INTEREST IN SAN
ONOFRE NUCLEAR GENERATING STATION UNITS 2
AND 3 TO THE CITY OF ANAHEIM.
WHEREAS, Southern California Edison Company (Edison) and
San Diego Gas and Electric Company (San Diego) presently own, as
tenants in common, a nuclear generating station known as the San
Onofre Nuclear Generating Station (San Onofre); and
WHEREAS, Edison, the City of Riverside (Riverside), the
City of Anaheim (Anaheim), and the City of Banning (Banning) en-
tered into a Settlement Agreement, dated August 4, 1972, under which
Edison offered to Riverside, Anaheim and Banning, participation in
the ownership and output of Units 2 and 3 at San Onofre; and
WHEREAS, Anaheim desires to participate in the ownership,
construction and operation of San Onofre Units 2 and 3; and
WHEREAS, in order to accomplish such participation, the
approval of the Nuclear Regulatory Commission (NRC) to transfer to
Anaheim a partial ownership interest in San Onofre Units 2 and 3
must be obtained; and
WHEREAS, an application to the NRC seeking permission to
transfer an ownership interest to Anaheim has been prepared by
Edison and reviewed by the City Council and is on file in the office
of the City Clerk.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim as follows:
1. Resolution No. 77R -697 approving certain agreements re-
lating to Anaheim's participation in San Onofre Units 2 and 3 and
authorizing the General Manager of the Utilities Department to exe-
cute said agreements is hereby affirmed.
2. The application, including the exhibits thereto pertain-
ing to Anaheim, for permission to transfer an ownership interest to
the City of Anaheim and for amendment to Construction Permits
Numbers CPPR -97 and CPPR -98 on file with the City Clerk of the City
of Anaheim be, and the same is hereby, approved.
3. The General Manager of the Utilities Department (General
Manager) on behalf of Anaheim is authorized and directed to execute
the application, including the exhibits thereto pertaining to
Anaheim. The General Manager on behalf of Anaheim is also author-
ized to make such nonsubstantive changes or modifications to the
application as the General Manager believes are appropriate and are
approved by legal counsel for Anaheim and the General Manager is
authorized to verify the information contained in said application.
4. The City of Anaheim agrees pursuant to the requirements
contained in 10CFR Section 50.37 that in the event said application
is approved by the NRC, Anaheim will not permit any individual to
have access to "Restricted Data," as that term is defined in 10CFR
Section 50.2(o), until the Civil Service Commission shall have de-
termined that permitting such person to have access to Restricted
Data will not endanger the common defense and security.
BE IT FURTHER RESOLVED that the General Manager of the
Utilities Department is authorized and directed to submit the fil-
ing fee in connection with said application to Edison.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 17th day of July, 1979.
