A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING THE RATES, RULES AND
REGULATIONS FOR THE SALE AND DISTRIBUTION OF
ELECTRIC ENERGY AS ADOPTED BY CITY COUNCIL
RESOLUTION NO. 71R -478 AND AMENDED BY CITY
COUNCIL RESOLUTION NOS. 73R -25, 73R -373,
73R -531, 74R -75, 74R -630, 75R -243, 75R -344,
75R -345, 76R -41, 76R -377, 76R -528, 76R -817,
77R -464, 77R -628, 78R -458 AND 78R -665.
WHEREAS, the City of Anaheim maintains an electric
distribution system for the furnishing of electricity to
residents and inhabitants of the City of Anaheim and has
adopted Electric Rates, Rules and Regulations for the sale
and distribution of electric energy; and
WHEREAS, it is the policy of the City Council that
Anaheim's Electric Utility shall be self supporting from
charges made by the City for electric energy furnished to
consumers and for services rendered in connection therewith;
and
WHEREAS, by Resolution 79R -190, the City Council
delegated to the Public Utilities Board the authority to
conduct hearings pursuant to the Public Utility Regulatory
Policies Act of 1979; and
WHEREAS, a hearing was held on Apri 18, 1979 before
the Public Utilities Board and evidence was presented in
connection with the proposed revision of electric rates; and
WHEREAS, the Public Utilities Board considered the
California Environmental Quality Act and made the following
findings:
1. The largest single item requiring a revenue increase
considering the test period of July 1, 1979 through
June 30, 1980 is purchased power at an estimated
cost of $66,984,000.
2. Other operating expenses and capital expenditures
estimated to cost $11,009,968 are due to salary
increases and higher material costs.
3. Debt service requirements and an increase in reserve
amounts estimated to cost $1,105,375 are required to
meet financial reserves and requirements.
4. The transfer to the general fund in an amount
estimated to be $2,834,000 is authorized by the City
Charter and constitutes an Intra -City transfer.

5. The working capital build -up in an amount
estimated to be $656,000 is necessary to provide
a reserve margin to meet current debts as they
mature and thus constitutes a reserve requirement.
6. The matters covered in la through le above come
within Section 21080(8) of the Public Resources
Code of the State of California thus the establish-
ment of these rates is exempt from the California
Environmental Quality Act; and
WHEREAS, a Notice of Hearing in compliance with the
National Energy Act of 1978 was published as follows:
1. On April 6, 7, 9, 10, 11, 12 and 13, 1979, a notice of
the public hearing on electric rates was published in
the Anaheim Bulletin and proof thereof is on file with
the Secretary of the Public Utilities Board.
2. On April 6, 8, 9, 10, 11, 12 and 13, 1979, notice of
the public hearing on electric rates was published
in the Santa Ana Register and proof thereof is on file
with the Secretary of the Public Utilities Board.
3. On April 6, 7, 8, 9, 10, 11 and 12, 1979, notice of
the public hearing on electric rates was published in
the Orange County Edition of the Los Angeles Times and
proof thereof is on file with the Secretary of the
Public Utilities Board; and
WHEREAS, the Public Utilities Board has considered the
proposal of the Public Utilities Department and has considered
the evidence presented at the public hearing; and
WHEREAS, the Public Utilities Board has made the
following findings with respect to the need for an electric
rate increase:
1. The Electric System revenue requirement of the Anaheim
Public Utilities Department will be established, as
set forth below, on the basis of projections for a
Test Period consisting of the twelve months July 1,
1979 through June 30, 1980.
2. A reasonable estimate of the revenue requirement for
Purchased Power Expenses for the test period is
$66,984,000 as shown in Exhibit 2.
3. A reasonable estimate of the revenue requirement for
other operating expenses for the test period is
$6,909,044 as shown in Exhibit 2.

4. A reasonable estimate of the revenue requirement
for Capital Expenditures for the test period is
$4,100,924 as shown in Exhibit 2.
5. A reasonable estimate of the revenue requirement for
Debt Service and Reserve Increase for the test period
is $1,105,375 as shown in Exhibit 2.
6. A reasonable estimate of the revenue requirement for
transfer to the general fund for the test period is
52,834,000 as shown in Exhibit 2.
7. A reasonable estimate of the revenue requirement off-
sets due to other electric revenues and interest
income for the test period is 5995,000 as shown in
Exhibit 2.
8. The Public Utilities Department presented testimony
that a working capital build -up of $1,656,000 was
necessary as shown in Exhibit 2. However, since the
Public Utilities Department has also recommended that
an Energy Cost Adjustment clause be included in the
electric rates to prevent the erosion of revenues and
we agree with such recommendation, it is the opinion
of the Board that working capital build -up may be
reduced by $1,000,000. Such a reduction will permit
the Department to have sufficient working capital and
will allow a $1,000,000 reduction in revenue require-
ments. Such reduction should be used to reduce the
proposed rates for the residential customer class.
An estimated revenue requirement of $81,594,343 as set
forth below, is appropriate for the test period:

10. It is appropriate to perform a cost -of- service study
in order to determine the allocated revenue require-
ment for the test period for the following customer
classes: Residential; Small Commercial; Large
Commercial; Industrial; Agricultural and Pumping;
Street Lights; and Municipal.
11. The customer class revenue requirements as deter-
mined on the basis of a cost of service analysis
are shown in Exhibit 5 and are appropriate except
as modified pursuant to Finding 8, page 3 of this
resolution:

12. Section 1221 of the City Charter provides that utility
rates charged to a class of consumers shall be uniform
within the class and shall be based on cost of service
for the class. Section 1221 also provides that lifeline
rates may be established, which rates would not neces-
sarily be based on cost of service.
13. The California Public Utilities Commission has
established lifeline rates for Southern California
Edison Company (Edison) and Edison is the retail
supplier of electric service in all the communities
surrounding Anaheim, and therefore, it is appropriate
to establish residential lifeline rates for Anaheim
which are essentially the same as Edison lifeline rates.
14. To the extent that the Anaheim lifeline rates produce
lower revenues than would be produced by rates based
on cost -of- service, the rates charged for non lifeline
sales must be increased above the level of rates based
on cost -of- service. The difference between the revenues
from sales made at the lifeline rates and revenues from
those sales made at cost -of- service rates is the life-
line shortfall.
15. In allocating the lifeline shortfall to the non lifeline
customers, it is appropriate to give consideration to
both cost -of- service and the retail rates of Edison.
16. On the basis of the preceding finding, the class
revenues under the proposed rates as shown in Exhibit
8 are reasonable and appropriate except as modified
pursuant to Finding 8, page 3 of this resolution:

17. Considering the current volatility of energy prices,
the fact that the energy component of purchased power
costs is about 59 percent of the test period revenue
requirement for the Anaheim Electric Utility, and the
fact that Edison's wholesale rate charged to Anaheim
changes monthly because of an automatic fuel cost
adjustment clause, it is appropriate and necessary for
the Anaheim Electric Utility to include an Energy Cost
Adjustment clause in its electric rates. Accordingly,
the Schedule ECA, Energy Cost Adjustment, shown as
Exhibit 9 should become effective on June 1, 1979 when
the new base rates become effective.
18. The base rates set forth in Exhibit 10 are appropriate
except that Schedule Nos. DS and DSM should be modified
to reflect the reduction of $1,000,000 in revenue
requirements pursuant to Finding 8, page 3 of this
resolution, and should become effective on June 1, 1979.
19. The proposed modification to Rule No. 16 of the Rules
and Regulations applicable to rendering electric
service by the City with respect to separate metering
is appropriate and should become effective on June 1,
1979.
20. The proposed electric rate increases meets the White
House Council Wage and Price Stability standards which
became effective on March 22, 1979. Those standards
limited rate increases by electric and gas utilities
to 6.5% annually, except for increased purchased power
costs which can be passed through to customers on

a dollar for dollar basis Although the total
proposed rate increase is 11.9% this Board is rec-
ommending an increase to 10.6 However, if the
cost of purchased power is excluded, the amount of
the increase is 3.2 and
WHEREAS, the Public Utilities Board considered the
Public Utility Regulatory Policies Act of 1978 (PURPA) Standards
and made the following findings:
1. The retail electric sales of the Anaheim Public
Utilities Department exceed 500 million kilowatt-
hours per year and, therefore, the Department is
covered by Title 1 of the Public Utilities Regulatory
Policies Act of 1978.
2. The California Public Utilities Commission does not
have rate- making authority with respect to the
Anaheim Public Utilities Department and, therefore,
responsibility for the consideration and determination
of certain ratemaking standards set forth in PURPA lie
with this Board and the Anaheim City Council.
3. Consideration was given to each of the six standards
of Section 111 of PURPA, to each of the five standards
of Section 113 of PURPA and to the Lifeline Rate
Standard of Section 114 of PURPA. Each of those
standards is discussed in the prepared testimony
presented by the Public Utilities Department.
4. The cost -of- service standard of Section 111 of PURPA.
The Public Utilities Department presented an allocated
cost -of- service study and presented rates for each
customer class which were based on cost -of- service.
The rates recommended by this Board differ from cost-
of-service only to the extent necessary to distribute
the lifeline short -fall to the remaining customer
classes. As shown in Finding 16, pages 4 and 5 of
this resolution, except for the Residential class, all
classes will pay rates which produce revenues equal to
or greater than the allocated cost of service.
5. The Declining Block Rate Standard of Section 111 of
PURPA. The energy components of the rates recommended
by this Board for the major rate schedules (all the
residential rates, the Commercial rates A and B of
Schedule GS -1, and the GS -2 Industrial Rate) do not
have declining block energy charges except for those
contained in the Residential Lifeline Rates. Two of
the minor rate schedules, Schedule No.PC Power
Connected Load Basis and Schedule PA do continue to
contain declining blocks. However, those blocks are
designed on the basis of kwh per horsepower rather

than kwh only. Because the cost of service per
kwh declines if the demand, in either horsepower or
kilowatts, remains fixed and the kwh usage increases,
the declining blocks of schedules PC and PA appear to
be justified by cost -of- service considerations.
6. The Time -Of -Day Rate Standard of Section 111 of PURPA.
The Public Utilities Department has budgeted $30,000
to purchase time -of -day meters and plans to conduct a
time -of -day metering study and develop the information
necessary to estimate the magnitude of savings and
costs which would be associated with time -of -day rates.
We believe that it would be premature for the Depart-
ment to offer time -of -day rates without sufficient study.
Time is available to make the necessary studies since
the required determination with respect to time -of -day
rates can be made at any time prior to November 9,
1981, according to Section 112(b) of PURPA.
7. The Seasonal Rate Standard of Section 111 of PURPA. The
Public Utilities Department intends to continue to
study seasonal rates in conjunction with its studies of
time -of -day and interruptible rates. Therefore, no
determination with respect to seasonal rates is made
at this time.
8. The Interruptible Rate Standard of Section 111 of PURPA.
The Public Utilities Department intends to continue
to study interruptible rates in conjunction with its
studies of time -of -day and seasonal rates. Therefore,
no determination with respect to Interruptible rates
is made at this time.
9. The Load Management Techniques Standard of Section 111
of PURPA. The Public Utilities Department has several
load management programs under way and intends to
expand its Conservation Services Division in order to
offer additional conservation and load management
information and programs to the Department's customers.
10. The Master Metering Standard of Section 113 of PURPA.
Rule No. 16 of the Rules and Regulations applicable to
providing electric service by the City should be
modified to require separate meters within a residen-
tial multi family accommodation for new installations
on and after June 1, 1979.
11. The Automatic Adjustment Clauses Standard of Section
113 of PURPA. For the reasons set forth in Findings
8, page 3, and 17, page 5, of this resolution,we find
that an automatic Energy Cost Adjustment should be
made effective June 1, 1979.

12. The Information to Consumers Standard of Section 113
of PURPA. The Public Utilities Department has stated
that it intends to comply with the Information to
Consumers Standard of PURPA.
13. The Procedures For Termination of Electric Service
Standard of Section 113 of PURPA. The Public Utilities
Department has indicated that it intends to comply with
the standard set forth in PURPA. The Department's
current procedures appear to comply with the PURPA
standard.
14. The Advertising Standard of Section 113 of PURPA. The
Public Utilities Department is in compliance with the
PURPA Standard since it does not engage in political
or promotional advertising or expend funds in connec-
tion therewith.
15. The Lifeline Rates Standard of Section 114 of PURPA.
For the reasons set forth in Finding 13, page 4 of
this resolution, this Board recommends the establishment
of Residential Lifeline Rates which are essentially the
same as the Lifeline Rates charged by Edison in the
communities surrounding Anaheim; and
WHEREAS, based on the findings hereinabove made, the
Public Utilities Board of the City of Anaheim recommended to
the City Council that the Council adopt the findings of the
Public Utilities Board with respect to the matters contained
herein and adopt the electric rates as shown in Exhibit 10,
modified to reduce the proposed rates for Schedule Nos. DS and
DSM and as shown in Exhibit 9 pertaining to the Energy Cost
Adjustment Clause to become effective for service rendered on
and after June 1, 1979; and
WHEREAS, the City Council has considered the
evidence and concurs with the findings of the Public Utilities
Board as set forth hereinabove.
NOW, THEREFORE, BE IT RESOLVED that the findings of
the Public Utilities Board be, and they are hereby, adopted by
the City Council of the City of Anaheim.
BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that the Electric Rates, Rules and Regulations
adopted by City Council Resolution No. 71R -478 and amended by
City Council Resolution Nos. 73R -25, 73R -373, 73R -531, 74R -75,
74R -630, 75R -243, 75R -344, 75R -345, 76R -41, 76R -377, 76R -528,
76R -817, 77R -464, 77R -628, 78R -458 and 78R -665 be amended as
follows to wit:

APPLICABILITY
Applicable to all areas served by the Utility and to all kilowatt hours billed
under all rate schedules as defined under the special conditions of the rate
schedules.
PURPOSE
To for increases and decreases of the Utility's charges for electric
service to reflect increases and decreases in the energy component of the cost
of purchase power.
APPLICATION OF ENERGY COST ADJUSTMEW
The Energy Cost Adjustment Billing Factor or Factors (ECABF), in cents per kwh,
which are set forth in Section D, shall be applied to kilowatt hours sold on
and after the effective date, as also set forth in Section D, and continuing
thereafter until the next Energy Cost Adjustment Billing Factors become
effective. The dollar amount to be added to or subtracted from each bill due
to the Energy Cost Adjustment shall be obtained by multiplying the number of
kilowatt hours for which the bill is rendered by the applicable Energy Cost
Adjustment Billing Factor or Factors. The Energy Cost Adjustment Billing
Factor for Lifeline Service shall be applied to all kilowatt hours purchased
at the Lifeline rate. The Energy Cost Adjustment Billing Factor for other
than Lifeline service shall be applied to all kilowatt hours purchased at rates
other than the Lifeline rate.

The Energy Cost Adjustment Billing Factors, in cents per kilowatt hour, shall
be shown in this Section.

CALCULATION OF THE ENERGY COST ADJUSTMENT BILLING FACTORS
1. The Energy Component of Purchased Power Costs included in the Utility's
Base Rates is 2.26 cents per kilowatt hour.
2. The Initial Energy Cost Adjustment Billing Factors established under
this Schedule ECA shall be determined as follows, based on estimated data
available 1 to 30 days before the Factors are to become effective:
a. Determine the energy, in kwh, estimated to be purchased by the
Utility in the first six months during which the Base Rates shall be
in effect.
b. For the period stated in part a) above, determine the estimated
amount, in dollars, of the energy component of the cost of
purchased power.
c. For the period stated in part a) above, determine the energy, in
kwh, estimated to be sold by the Utility under all rate schedules
except the Lifeline portion of the rate schedule.
d. The Initial Energy Cost Adjustment Billing Factor applicable to
all sales except the Lifeline portion of sales shall be calculated
by the following formula:

Where: C The estimated amount, in dollars, of the energy component

as determined in b) above.
e. The Initial Energy Cost Adjustment Billing Factor applicable to
Lifeline rates shall be 0.000 per kwh.
3. Following the Initial Energy Cost Adjustment Billing Factors, all
subsequent Energy Cost Adjustment Billing Factors shall be determined as follows:

a. An Energy Cost Balancing Account shall be established. At the.
end of each month, the account balance will be calculated by:
i. Subtract from the balance which existed at the end of the
prior month the amount, in dollars, (which may be positive or
negative) by which the actual cost of the energy component of
purchased power for the current month exceeds the product of
2.26 cents per kwh times the actual amount of purchased energy,
in kwh, for the current month.
ii. Add the amount, in dollars, recovered from the application of
ECA Billing Factors which were effective during the month. Such
amount shall be the product of kwh of energy billed during the
month and the applicable ECA Billing Factors.
b. Within 45 days after the end of each month, the Public Utilities
Department shall prepare and distribute as set forth in (d) following,
a report which shall show:
i. The ECA Billing Factors charged during each of the preceding
twelve months.
ii. The balances in the Energy Cost Balancing Account at month
end for each of the preceding twelve months.
iii. Estimated amounts of the following items for each of the
subsequent six months:

ii. The balance in the Energy Cost Balancing Account should be
maintained between a positive $1,000,000 and a negative $250,000.
It shall be the practice of the Public Utilities Department to
make appropriate adjustments to the ECA Billing Factors, based on
the estimates for the six -month forecast period, so as to maintain
the account balance within the established limits. If, at any time
the account balance does become greater than a positive $1,000,000,
or less than a negative $250,000, an adjustment in the ECA Billing
Factors shall be made so as to return the account balance to within
the established limits.
d. The Public Utilities Department shall furnish to the Public
Utilities Board and to the City Council the report discussed in

1. Applicability. Lifeline service shall be made available only to
domestic service billed on Schedules Nos. DS, DSM and DSMS.
2. Eligibility. All domestic customers on Schedules Nos. DS, DSM and DSMS
are entitled to an allocation of a lifeline quantity of electricity which is
necessary to supply the minimum energy needs of the average residential user:
a. For basic residential use; and,
b. If qualified, for water heating and space heating; and,
c. If qualified, for an essential life- support device used by a full
time resident of a residential household.
3. Basic Residential Use. Each eligible domestic customer will be allowed
a lifeline quantity of electricity for lighting, cooking, and food refrigerating,
which is specified as basic residential use. The lifeline quantity of electri-
city for basic residential use is set forth on the applicable rate schedules
and is to be billed at the rates designated.
4. Water Heating. Each eligible domestic customer may be allowed an
additional lifeline quantity of electricity for water heating, upon application
to the Utility if electricity is the domestic customer's primary source for
water heating. The lifeline quantity of electricity for water heating is set
forth on the applicable rate schedule and is to be billed at the rates
designated.
5. Space Heating. Each eligible domestic customer may be allowed an
additional lifeline quantity of electricity for space heating for service
rendered during the months of November through April, inclusive, upon applica-
tion to the Utility if electricity is the domestic customer's primary source
for permanently installed space heating. The lifeline quantity of electricity
for space heating is to be billed at the rates designated.
6. Life Support Devices in Customer's Residence. Each eligible domestic
customer may be allowed an additional lifeline quantity of electricity, upon
application to the Utility where such customer provides certification that a
full -time resident of the household regularly requires the use of an essential
life- support device, such as a respirator, iron lung, or kidney dialysis
machine.

Procedure for Certification
The Utility may require that:
a. The customer have a medical doctor or osteopath licensed to
practice medicine in the State of California provide the Utility
with a letter, acceptable to the Utility, describing the type of
regularly required life- support device and the utilization require-
ments in detail; or
b. County, State, or Federal agencies, using an established notifica-
tion letter to electric utilities, provide the Utility with
information relative to patients who regularly require the use of
a life- support device in the home.
Upon the above certification, the Utility shall estimate the monthly consumption
of the particular life- support device, given the usual hours of operation per
month, and within 30 days add the incremental estimated monthly usage to the
customer's lifeline quantity. The Utility may require a new or renewed applica-
tion and /or certification when needed, in the opinion of the Utility.
7. Verification. Not more than one lifeline quantity will be allowed for
each single family dwelling or accommodation on the premises for each of the
end uses set forth in Paragraphs, 3, 4, 5 and 6 above. However, where there are
multiple life- support devices at such single family dwelling or accommodation,
all such certified devices shall be totaled for one lifeline quantity. The
number of single family accommodations on the premises and the existence of the
specified end use equipment required to obtain certain lifeline quantities of
electricity, as set forth on the applicable rate schedules, are subject.to
verification by the Utility.
In the event the Utility ascertains that the customer is not eligible for
such additional lifeline quantity, such customer may be rebilled as if no such
additional lifeline quantity had been allowed.
8. Termination of Use. Customers shall give the Utility notice of
termination of use of equipment or devices set- forth in Paragraphs 4, 5, and
6 above.
9. Billing. The customer charge and the energy charge shall be billed in
the appropriate blocks at the rates designated as applicable to lifeline service
up to the total of the applicable lifeline quantities as determined in
accordance with Paragraphs 3, 4, 5 and 6 above. Usage in excess of the total
applicable lifeline quantities shall be billed in the blocks continuing from

A. The rate applies to service rendered at 240 or 480 volts at the option of the
consumer. 746 watts shall be equivalent to 1 HP.
B. Whenever, upon test, any equipment is found to be delivering more than 125%
of its capacity as indicated by its nameplate rating, the City may disregard
the nameplate rating and base its charges upon the actual output as calculated
from the test.
C. Where the use of energy is seasonal or intermittent, no adjustment will be
made for any temporary reduction of connected load. Any customer resuming
service on such connected load within 12 months after it was disconnected,
will be required to pay all charges which would have been billed if the
temporary reduction of connected load had not been made.
D. Energy Cost Adjustment:
The rates above are subject to adjustment as provided for in Schedule ECA.
The applicable energy cost adjustment billing factor set forth therein will
be applied to all kwhr billed under this schedule.

Enclosed luminaires will be furnished for lamps of 2500 lumens, or larger.
Such standard lighting equipment will be attached to wood poles.
B. Other Than Standard Equipment. Where the customer requests the installation
of other than the standard equipment and such requested equipment is acceptable
to the City, the City will install the requested equipment provided the customer
agrees to advance the estimated difference in cost installed between such
equipment and standard equipment. Advances made for this purpose will not be
refunded. Facilities installed in connection with such agreements become and
remain the sole property of the City.
C. Hours of Service: Approximately 4140 hours per year.
D. Energy Cost Adjustment: The rates above are subject to adjustment as
provided for in Schedule ECA. The applicable energy cost adjustment billing
factor set forth therein will be applied to 20 kwhr per month per 1000 lumens
for incandescent lamps, to 8 kwhr per month per 1000 lumens for mercury vapor

will be installed for each luminaire in the installation.

D. The utility will replace lamps on a scheduled basis, and individual lamps
will be replaced upon service failure, as soon as practical after notification
by the customer, subject to utility's operating schedules.
E. A written contract for a term of one year will be required by utility when

A. METER INSTALLATIONS AND MISCELLANEOUS SERVICE EQUIPMENT ON CUSTOMER'S
PREMISES.
a. Location. All meters installed by the Utility shall be installed at
some convenient place, approved by the Utility, upon the customer's
premises and so placed as to be at all times accessible for
inspection, reading and testing.
The customer shall, at his own expense, provide a new and approved
location for the meter or meters in order to comply with the fore-
going whenever the existing meter or meters become inaccessible for
inspection, reading, or testing.
b. Separate Meters Required. Each single family dwelling or
accommodation within a residential multifamily accommodation will
be separately metered by the Utility for new installations on
and after June 1, 1979, except where a commitment for installation
of other than separate metering has been made by the Utility to the
owner /developer prior to such date. However, if said commitment
has not been exercised within an ensuing period of twelve months,
separate metering of electric service for each residential unit
is required.
c. Multiple- occupancy Buildings. In all buildings in which meters are
required to be installed for various floors or groups of rooms
in order to measure separately the electrical energy supplied to
each of several customers, all meters shall be located at one
central point or as otherwise specified by the Utility. Each
meter position shall be clearly marked, by the building owner,
to indicate the particular location supplied by it.
d. Master Meters. A master meter will be furnished and installed by
the Utility, except as provided in Section A.1.b. above, upon
application by the owner or lessee of any residential building
where the floors (or portions thereof) or rooms or groups of
rooms are rented separately and where electric energy is to be
metered and resold by said owner or lessee shall furnish, install,
maintain, and test the submeters.
e. Sealing of Meters. All utility meters will be sealed by the Utility,
and no such seal shall be tampered with or broken except by a
representative of the Utility authorized to do so.
