1979-264RESOLUTION NO. 79R -264 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE AND ABANDON CERTAIN PUBLIC STREETS AND ALLEYS AND FIXING A DATE FOR A HEARING THEREON. (LINCOLN AVENUE, ET AL.) WHEREAS, the City Council of the City of Anaheim does hereby elect to proceed under the provisions of the Street Vacation Act of 1941 (Section 8300 et sec., Streets and Highway Code) in connection with requests for vacation and abandonment of public streets located within the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby declare its intention to vacate, abandon and close to public use the following described streets and alleys, to wit: A. Lincoln Avenue that portion extending; from Anaheim Boulevard to Clementine Street; B. Lemon Street that portion extending from Oak Street to a point approximately 332 feet north of the centerline of Lincoln Avenue; C. Clementine Street an irregularly shaped portion of Clementine Street extending from a point approximately 178 feet north of the centerline of Lincoln Avenue to a point ap- proximately 110 feet south of Lincoln Avenue; 7). That certain east -west alley lying approxi- mately 185 feet north of Lincoln Avenue between Anaheim Boulevard and Clementine Street; and E. That certain north -south alley lying northerly of Lincoln Avenue, westerly of Yjemon Street, extending from the east -west alley to a point approximately 50 feet northerly thereof, as said streets and alleys are shown on a map or plan on file in the Office of the City Clerk of the City of Anaheim. BE IT FURTHER RESOLVED that these proceedings are under- taken subject to the following reservations and exceptions in favor of the following persons or parties: A. Reserving from the Lemon Street abandonment, above described, the following interests in favor of the following parties: (1) Reserving unto the City of Anaheim, a 36 to 44 -foot wide public utility easement including, but not limited to, sanitary sewer and storm drain purposes. (2) Reserving unto the Pacific Telephone and Telegraph Co., a 36 to 44 -foot wide ease- ment for telephone, telegraph, and com- munication purposes, subject to the prior rights of the City of Anaheim under Paragraph (1) above. (3) Reserving unto the Southern California Gas Co., a 36 to 44 -foot wide easement for public utility purposes, subject to the prior rights of the City of Anaheim under Paragraph (1) above. B. Reserving from the Clementine Street abandon- ment, above described, the following interests in favor of the following parties: (1) Reserving unto the City of Anaheim, a 20- foot wide public utility easement includ- ing, but not limited to, sanitary sewer and storm drain purposes. (2) Reserving unto the Pacific Ielephone and Telegraph Co., a 20 -foot wide easement for telephone, telegraph, and communica- tion purposes, subject to the prior rights of the City of Anaheim under Paragraph (1) above. (3) Reserving unto the Southern California Gas Co., a 20 -foot wide easement for public utility purposes, subject to the prior rights of the City of Anaheim under Para- graph (1) above. BE IT FURTHER RESOLVED that all persons interested in or objecting to said vacation and abandonment will be heard at a public hearing to be held at 3:00 o'clock P.M., or as soon there- after as the matter may be heard, in the Council Chamber in the City Hall, 204 East Lincoln Avenue, Anaheim, California, on: May 29, 1979 BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and shall cause the same to be published in the Anaheim Bulletin, a newspaper of general circula- tion, printed, published and circulated in said City of Anaheim.
