A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 3110.
WHEREAS, after a request for variance by TEACHERS'
INSURANCE AND ANNUITY ASSOCIATION OF AMERICA, owner,
ELECTRICAL PRODUCTS CORPORATION and CALIFORNIA COMPUTER
PRODUCTS, INC., agent, was received, a public hearing before
the Planning Commission of the City of Anaheim was held upon
due and proper notice as a result of which Variance No. 3110
was granted, covering the following described property:
Beginning at a point on the South line of said
Southwest quarter of Section 6 which is South
89 21' 20" West 766.88 feet from the Southeast
corner thereof; thence continuing along said
line, South 89° 21' 20" West 60.00 feet to the
Southeast corner of that certain exception of
the South 284.00 feet of the West 163.00 feet
recited in the deed recorded July 31, 1962, as
document No. 23009, in Book 6197, Page 76,
Official Records of said county; thence along
the boundary of said exception North 00 46'
20" West 284.00 feet and South 89° 21' 20" West
163.00 feet to the Northwest corner of said
exception; thence North 00° 46' 20" West 230.35
feet to the Southeast corner of the parcel of
land conveyed to the Emerson Electric Manufactur-
ing Company as described in Parcel No. 2 of the
deed recorded July 31, 1962, as Document No.
23009 in Book 6197, Page 76, Official Records of
said county; thence South 89° 57' 10" East 193.02
feet; thence North 00° 46' 20" West 891.75 feet
to a point in the Southwesterly right of way
line of the Southern Pacific Railroad Right of
Way; thence along said right of way line South
57 13' 50" East 956.10 feet to its intersection
with the East line of the said Southwest quarter
of Section 6; thence along said East line and
the centerline of Gilbert Street, South 0° 46'
30" East 545.69 feet to a point in a line paral-
lel with and 331.50 feet Northerly from the South
line of the said Southwest quarter of Section 6;
thence South 89° 21' 20" West 766.86 feet along
said parallel line; thence South 0° 48' 20" East
331.50 feet to the point of beginning. Except
the most Southerly 53.00 feet.

WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the following
findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim, that a conditional zoning variance
be, and the same is hereby granted, permitting the construc-
tion of a free standing sign on the property hereinbefore
described with waivers of the following sections of the
Anaheim Municipal Code:
(a) SECTION NO. 18.05.067 Minimum distance of
flashing sign to residen-
tial structures.
(300 feet required
225 feet proposed)
(b) SECTION NO. 18.05.067.010 Maximum height of flashing
sign. (25 feet permitted
within 500 feet of resi-
dential structures; 32
feet proposed)
(c) SECTION NOS. 18.05.098 and 18.05.093.022

(d) SECTION NOS. 18.05.098 and 18.05.093.0241 Maximum

That said variance be granted subject to the following
conditions:
1. That street lighting facilities along Gilbert
Street shall be installed as required by the Office of
Utilities General Manager, and in accordance with specifica-
tions on file in the Office of Utilities General Manager;
and /or that a bond, certificate of deposit, letter of credit,
or cash, in an amount and form satisfactory to the City of
Anaheim shall be posted with the City to guarantee the instal-
lation of the above mentioned requirements prior to final
inspection of the proposed sign.
2. That the owner of subject property shall submit
a letter requesting the termination of Variance No. 1942 to
the Planning Department.
3. That subject property shall be developed sub-
stantially in accordance with plans and specifications on
file with the City of Anaheim marked Exhibit Nos. 1 and 2.
4. That Condition Nos. 1 and 2, above mentioned, shall
be complied with prior to the commencement of the activity
authorized under this resolution, or prior to the time that
the building permit is issued, or within a period of one year
from date hereof, whichever occurs first, or such further
time as the Planning Commission may grant.
5. That Condition No. 3, above mentioned, shall be
complied with prior to final building and zoning inspections.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owners, its heirs, successors or
assigns to comply with the Anaheim Municipal Code and regula-
tions and the conditions herein. Said variance is granted
for the term prescribed by the Anaheim Municipal Code unless
otherwise specified herein.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 23rd day of
October, 1979.
