A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DETER THAT CERTAIN PUBLIC
ALLEY SHOULD BE ABANDONED AND ESTABLISHING
CONDITIONS PRECEDENT TO SAID ABANDONMENT.
WHEREAS, the City Council of the Ctiy of Anaheim has
elected to proceed under the provisions of the Street Vacation
Act of 1941 (Section 8300 et seq., Streets and Highways Code) in
connection with requests for vacation and abandonment of public
streets within the City of Anaheim; and
WHEREAS, the City Council did, by resolution duly posted
and published, give notice of its intention to abandon the follow-
ing described public alley; to wit, an unnamed public alley (herein-
after Alley) more specifically described as follows:
That certain public alley extending westerly
from Orange Street to a point approximately
152 feet westerly thereof, said alley located
approximately 144 feet south of Adele Street; and
WHEREAS, on the 2nd day of October, 1L79, a public hear-
ing was held to allow interested persons to submit evidence concern-
ing said proposed abandonment; and
WHEREAS, the City Council of the City of Anaheim does find
from the evidence submitted to it that said Alley is unnecessary
for present or prospective public use; and
WHEREAS, the City Council has further determined that
certain conditions must be met prior to making of an order vacating
and abandoning said Alley.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does determine that said Alley should be aban-
doned and vacated subject to the following conditions:
Removal of the existing asphaltic concrete over
aggregate base and manhole, plug the existing
sanitary sewer line and construct a new manhole
at the west terminus of the abandonment area.
BE IT FURTHER RESOLVED that should the conditions set
forth in the preceding paragraph be fulfilled within one hundred
eighty (180) days of the date of this Resolution, the City Council
will make its order vacating and abandoning said Alley.
BE IT FURTHER RESOLVED that should all of said condition
not be fulfilled within said one hundred eighty (180) days or such
further time as the City Council may grant, then this Resolution
shall terminate, and resort shall be had to a new and separate
proceeding.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 2nd day October, 1979.
