A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANOE NO. 19l6
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zqning variance from LaRoy A.
Turner and Mildred L. Turner, owners
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
PARCEL 1:
A portion of the South Half of the Northeast Quarter, North-
east Quarter, of Section l3, Township 4 South, Range II West,
S.B.B. & M., in the City of Anaheim, County of Orange, State
of California, described as follows:
Beginning at the southeast corner of the Northeast Quarter,
Northeast Quarter, of said Section l3, said point also being
the center line intersection of Broadway and Magnolia Avenue;
thence South 890 36' 00 II \vest along the southerly line of
said Northeast Quarter, Northeast Quarter of Section l3, said
line also being the center line of Broadway 253.00 feet;
thence North 00 ll' 5011 West 45.00 feet to the True Point of
Beginning of this description; thence continuing North 00 ll'
50" West 288.17 feet; thence North 890 37' 2411 East 50.00 feet;
thence South 00 11' 50" East 288.l5 feet; thence South 890 36'
00" West parallel with said southerly line 50.00 feet to the
True Point of Beginning.
PARCEL 2:
A portion of the South Half of the Northeast Quarter, North-
east Quarter, Section l3, Township 4 South, Range II West,
S.B.B. & M., in the City of Anaheim, County of Orange, State
of California, described as follows:
Beginning at the southeast corner of the Northeast Quarter,
Northeast Quarter of Section l3, said point being the center
line intersection of Broadway and Magnolia Avenue, thence
South 890 36' 00" West along the southerly line of said North-
east Quarter, of the Northeast Quarter of Section l3, said
line also being the center line of Broadway 664.l3 feet;
thence North 00 11' 50" West 45.00 feet to the southeast
corner of Tract No. 2938 as shown on a map recorded in Book
119, Pages 28 and 29 of Miscellaneous Maps, records of said
Orange County, said point also being the True Point of
Beginning of this description; thence continuing North
00 ll' 50" West along the easterly line of said Tract No.
2938, 288.34 feet; thence North 890 37' 24" East 4ll.l3 feet;
thence South 00 ll' 5011 East parallel with said easterly line
of said Tract No 2938, 288.17 feet; thence South 890 36' 00"
west parallel with said southerly line 4ll.l3 feet to the
True Point of Beginning.

k~D ~mEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on September 25, 1967 , notice of which said public
hearing was Quly given as required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code; and

WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration Of all evidence and reports
offered at said hearing, did adopt R~solution No. PC67-22l
recommending that Variance No. 1916 ~e granted, subject to the
conditions therein set forth;and
WHEREAS, thereafter, withi~ twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in gran~inS said variance and
did set a public hearing thereon to be eld on the 24th day
of October , 19 67 , at 1:30 o'clock P.M. in the City
Hall in the City of Anaheim and notice of such public hearing
was duly given as required by law and the Provisions of Title 18,
Chapter l8.76 of the Anaheim Municipal Code; and
~VHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
l. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted permitting the construction of a
69-unit apartment complex on the property hereinbefore described,
with a waiver of the minimum distance between buildings (Section
l8.28.0S0(7-a) of the Anaheim Municipal Code), subject to the
following conditions:

1. That this variance is granted subject to the completion
of Reclassification Proceedings No. 67-68-24 now
pending.
2. That trash storage areas sball be provided in accordance
with approved plans on file in the Office of the
Director of Public Works aIlld Superintendent of Streets,
prior to final building and zoning inspections.

3. That fire hydrants shall be installed as required
and determined to be necessary by the Chief of the
Fire Department, said fire hydrants to be installed
prior to final building and zoning inspections.
4. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked Exhibits Nos. l, 2
and 3.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owners,
their heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 24th day of October, 1967.
