A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 965
WHEREAS, the City Planning C~mmission of the City of
Anaheim did receive an application fora conditional use permit
from DAVE DAVIDSON and GIORGIA MAR.GA.QT DAVIDSON, 134 West Ball
Road, Anaheim, California, to use an e~dsting residential struc-
ture situated on the property hereinaf~er described as a business
office, with waivers of the minimum n~ber of off-street parking
spaces required (Section l8.38.050(4-A~1) of the Anaheim MUnicipal
Code) and 6-foot solid masonry wall requirement on the zone boundary
line where a C-O, Commercial Office Zone abuts a residential zone
(Section 18.38.050(6) of the Anaheim M~nicipal Code). That said
property is situated in the City of An_heim, County of Orange,
State of California, and is more particularly described as
follows:
Lot 51 of Tract No. 2090, as shown on a map
recorded in Book 61, Pages 38 and 39 of
Miscellaneous Maps, Records of Orange County,
California.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on September 25 , 19 67 , notices of
which said public hearing were duly g~ven as.required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and

WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. PC67-2l9 ,
granting Conditional Use Permit No. ~65 ,Subj ect to
the conditions therein set forth ; and
WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in ~ranti~ said conditional use
permit and did thereupon fix t e 24th day of October ,
19 6~ ' as the time and the Coun~er in the City Hall
of t e City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and

WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commis-
sion and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full devplopment of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
ssion in granting said conditional use permit be, and the
same is hereby sustained , and that Conditional Use Permit
No. 965 be, and the same is hereby, granted permitting
an existing residential structure situated on the property herein-
before described to be used as a business office, and permitting
waivers of the following Anaheim Municipal Code requirements:
(a) A waiver of the minimum number of off-street parking
spaces required (Section 18.38.050(4-A-1)); and
(b) A waiver of the 6-foot solid masonry wall requirement
on the zone boundary line where a C-O, Commercial
Office Zone abuts a residential zone (Section 18.38.050
(6)) ,
subject to the following conditions:

1. That this conditional use permit is granted subject to
the completion of Reclassification Proceedings No.
67-68-23 now pending.
2. That trash storage areas shall be provided in accordance
with approved plans on file in the Office of the
Director of Public Works and Superintendent of Streets,
prior to final building and zoning inspections.

3. That conversion of the existing structure on subject
property shall be in confor$ance with the Uniform
Building, Plumbing and Electrical Codes, as adopted by
the City of Anaheim for commercial structures, and
shall be completed prior to final building and zoning
inspections.
4. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anahe~, m.rked Exhibits Nos. 1, 2
and 3; PROVIDED, HOWEVER, that the parking area shall
be designed to provide a 2S-foot turning radius into
the alley.
The City Council hereby res,rves the right to revoke
such conditional use permit for good ~ause or failure of said
owners, their heirs, successors or aS$igns to comply with the
Anahe~ Municipal Code and regu1ation$ and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 24th day of October, 1967.
