1967-577 - RESOLUTION NO. 67R-577 .r- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AN ~NDMENT TO THAT CERTAIN AGREEMENT ENTERED INTO AS OF SEPTEMBER 3, 1967 WITH ANAHEIM POST NO. 72 AMERICAN LEGION. WHEREAS, the City Council has found that it will promote patriotism to display the flag of the United States in certain public places in the City of Anaheim on certain holidays; and WHEREAS, by Resolution No. 67R-502, dated the 29th day of August, 1967, the City Council authorized the execution of an agreement between the City of Anaheim and Anaheim Post No. 72 American Legion, a corporation, to display said flag; and WHEREAS, pursuant to said authorization that certain agreement dated the 3rd day of September, 1967, by and between the City of Anaheim and Anaheim Post No. 72 American Legion, a corporation, was executed by and between the parties thereto; and WHEREAS, the City does find that it is necessary to amend said agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 67R-502 and said agree- ment of September 3, 1967, by and between the City of Anaheim and Anaheim Post No. 72 American Legion, a corporation, be amended as follows: 1. paragraph No. 4 of Resolution No. 67R-502 shall read as follows: "That Anaheim Post No. 72 American Legion shall be paid for such services the sum of $l.50 per flag, per year for said five-year period, which con- sideration shall be paid yearly at the first regu- lar meeting of the City Council following Labor Day of each year, commencing Labor Day in 1967. 2. Paragraph No.5, page 2 of said agreement shall read as follows: UIn consideration of the services herein to be ren- dered by SECOND PARTY, and consideration of the covenants herein agreed to be performed by SECOND PARTY, FIRST PARTY agrees to pay SECOND PARTY the sum of One and 50/100 Dollars ($1.50) per flag, per year, for each of the years of said five-year period, which consideration shall be paid yearly at the first regular meeting of the City Council of the City of Anaheim following Labor Day of each year, commencing Labor Day in 1967." BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to sign such amendment to -1- - '-. agreement for and on behalf of the City of Anaheim. ."-' THE FOREGOING RESOLUTION is approved and signed by me this lOth day of October, 1967.
