A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 962
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application f~r a conditional use permit
from EARL H. DAHLMAN, llll River Lan~, Santa Ana, - California,
to establish a 204-unit apartment co~plex, with waivers of the
following Anaheim Municipal Code req$irements or limitations:
l. A waiver of the minimum di$tances between buildings
(Section l8.28.050(7));
2. A waiver of the maximum di$tance of living units
from a standard street (Section l8.28.0s0 (9-b));
and
3. A waiver of the carport lo~ation limitation,
that carports may abut a s~de property line only
within the rear 25% of a bUilding site (Section
l8 .28. 050 (6-b-3-c)),

on the following described property situated in the City of
Anaheim, county of Orange, State of ~alifornia, to wit:
That portion of the North half ~f the Northwest quarter
of the Southeast quarter of Section l2, Township 4 South,
Range lO West, in the Rancho San Juan Cajon de Santa Ana,
as shown on a map thereof recorded in Book 5l, page 10,
Miscellaneous Maps, records of said Orange County, in
the City of Anaheim, lying Northerly and Westerly of the
following described lines:
Commencing at the intersection of the center line of
Sunkist Street and Anaheim-Olive Road as said center
lines are shown on map of Tract No. 2490, recorded in
Book 79, pages 45 and 46, Miscellaneous Maps, records
of said Orange County; thence along said center line
of Sunkist Street, North 010 Oll 19" East, 8l.52 feet
to the true point of beginning; thence South 880 581 41"
East, 57.00 feet; thence South 3lo 27' 58" East, 49.40
feet to a line parallel with and distant Northerly
55.00 feet, measured at right angles, from said center
line of Anaheim-Olive Road; thence along said parallel
line, South 780 Ol' 24" East, 93.00 feet; thence
North 890 42' 42" East, l64.76 feet; thence
North 770 49' 06" East, 545.67 feet to a tangent curve
concave Northwesterly having a radius of 450.00 feet;
thence along said curve, Northeasterly, through an angle
of 700 03' 33", an arc distance of 550.24 feet to the
Northerly line of said Southeast quarter.
EXCEPT that portion of said North half, lying within the
following described lines:
Commencing at the center line intersection of Anaheim-

feet; thence Easterly along a line as measured at

a line parallel to and 222.35 f~et Easterly of Sunkist
Street, 26l.27 feet to the cent$r line of Anaheim-
Olive Road; thence North 780 011 24" West along the
center line of Anaheim-Olive Road, 226.48 feet to the
point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on AU'1llst 28 , 1967 , notices of
which said public hear~ng were duly given as required by law
and the provisions of Title l8, Chapter l8.76 of the Anaheim
Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. PC67-l99 ,
denying Conditional Use Permit No. 962; and
WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in denying said conditional use
permit and did thereupon fix the 26~h day of September
1967 , as the time and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
l8, Chapter l8.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and

WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commis-
sion and all evidence and reports offered at said hearing, that:
l. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.

2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.

5. The granting of the condit$onal use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City o~ Anaheim.
NOW, THEREFORE, BE IT RESO:ijVED by the City Council of
the City of Anaheim that the action Of the City Planning Commis-
sion in denting said conditional use permit be, and the
same is here y disaParoved , and that Conditional Use Permit
No. 962 be, an the same is h~reby, granted permitting
the establishment of a 204-unit apar~ent complex, on the prop-
erty hereinbefore described, with wailvers of the following
Anaheim Municipal Code requirements or limitations:
1. Minimum distances between buildings (Section
18.28.050(7)) ;
2. Maximum distance of living units from a standard
street (18.28.050(9-b)); and
3. Carports may abut a side property line only within
the rear 25% of a building site (Section l8.28.050
(6-b-3-c)) ,
subject to the following conditions:
l. That this conditional use permit is granted subject
to theco1llpletion of Reclassification Proceedings
No. 67-68-l7 now pending.
2. That subject property shall be developed sub-
stantially in accordance with plans and specifica-
tions on file with the City of Anaheim, marked
Exhibits Nos. l, 2 and 3.
The City Council hereby reserves the right to revoke
such conditional use permit for good cause or failure of said
owner, his heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by me
this lOth day of October, 1967.
