1967-367 filiSOLUTION NO. 67R- 367 A RESOLUTION OF THE CITY COill~CIL OF THE CITY OF ANAHEHl ORDERING THE VAC1\TION AND ABANDONIv.lENT OF ALL VEEICULl~R 1'1CCESS RIGHTS TO DUTCH AVENUE OVER AND ACROSS THE HEREIN- AFTER DESCRIBED P~AL PROPERTY. vlliEREAS, the City Council of the City of ~laheim, a Hunicipal Corporation of the State of California, did on the 13th day of June, 1967, pass its Resolution No. 67R-33l entitled "A RESOLUTION OF THE CITY COUl\JCIL OF THE CITY OF AN1IJiEIM DECLAR- ING IT S INTENTION TO VACATE NJD ABiillDON ALL 'BHICULAR ACCESS RIGHTS TO DU'l'CH AV'2NUE OVER AND ACROSS THE HEHEH1'l'J.FTER DESCRIBED REAL PROPERTY; FIXING Fl TILLe llJ.m PLl'~CE FOR A HEI-iRDJG THEREON, AND DIREC'I'ING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF 'l'HIS RESOLU'l'ION," whereby it declared its intention to vacate and abandon all vehicular access rights to Dutch Avenue over and across the hereinafter described property under the provisions of the Street Vacation Act of 1941, and vaIEREAS, the City Council in said resolution referred to a map on file in the Office of the City Clerk for further particulars as to the proposed vacation and abandonment of said vehicular access rightsi and :'JIIEllliAS, said City Council dia. by saic. resolution fix the 5th day of July, 1967, at 1;30 o'clock P.M., in the Council Chamber in the City Hall of the City of Anaheim as the time and place for a public hearing on the matter of such vacation and abandonment of said vehicular access rights to Dutch Avenue, for all persons interested in or objecting to such proposed vacation and abandonment to appear and show cause, if any they had, why such access rights sl10uld not be vacated and abandoned; ana. \~HEREAS, said resolution was published on the 22nd day of June, 1967, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, County of Orange, State of California, and HHERCAS, by said resolution said City Council directed that notices of the passage of said resolution and of the time and place of the hearing on the matter of the vacation and abandonment of said access rights to Dutch Avenue be posted con- spicuously along the line of said portion of Dutch Avenue as shown on a map of Tract No. 6138 and as described in said reso- lution, not more than 300 feet apart, at least ten (10) days before said hearing, and that not less than three (3) such notices should be posted; and WHEREAS, Donald R. O'Donnell did on the 22nd day of June, 1967, post conspicuously not less than three (3) such notices along the line of said portion of Dutch Avenue, which notices were posted not more than 300 feet apart, and were posted at least ten (10) days before said hearing; and -1- '""'--'--r""'--"- ~VHEREAS, said City Council did on the 5th day of July, 1967, at 1;30 o'clock P.M., at said City Hall, conduct a public hearing on the matter of whether said access rights to Dutch Avenue over and across the property hereinafter described should be vacated and abandoned; and WHEREAS, the City Council finds from all evidence submitted that said access rights described in the Resolution of Intention and hereinafter described are no longer beneficial to the public use of said avenue and that an order vacating and abandoning such access rights should be made. NOW, THEREFORE, BE IT P~SOLVED by the City Council of the City of Anaheim; 1. That it finds the recitals hereinabove set forth in this resolution to be true; 2. That it finds from all evidence submitted that said access rights to Dutch Avenue described in said resolution are no longer beneficial to the public use of said avenue; 3. That it does hereby order that said access rights be, and they are hereby, vacated and abandoned, 4. That said access rights herein ordered vacated and abandoned are those certain vehicular access rights to Dutch Avenue dedicated to the City of Anaheim, described in said Resolution No. 67R-331, located in the City of Anaheim, County of Orange, State of California, and more particularly described as follovlS: Those certain vehicular access rights to Dutch Avenue dedicated to the City of Imaheim as shown on the Map of Tract No. 6138, recorded in Book 229, pages 22, 23 and 24 of iliscellaneous Maps, records of Orange County, California. N~D BE IT FURTHER P~SOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution and order, attested by her under the seal of the City of Anaheim, to be recorded in the Office of the County Recorder of Orange County, California.
