1967-336RESOLUTION NO 67R -336 A RESOLUTION OF THE CITY COUNCIL OF THE CITY` OF ANAHEIM GRANTING VARIANCE NO 1881 WHEREAS, the City Planriii',9 Commission of the City of Anaheim did receive a petition for zoning variance from WILBUR L. WRIGHT et al. owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows That portion of Lots 6 and 7, of the South Placentia Tract No. 1, in the City of Anaheim, as shown on a map recorded in Book 5, Page 42, Miscellaneous Maps, records of said Orange County, lying South of a line parallel with and distant North 833.52 feet, from the South lines of said lots. EXCEPTING THEREFROM that portion of said land lying within the following described lines: Beginning at the intersection of the center lines of Sunkist Street and La Palma Avenue as said intersection is shown on map of Tract No. 3614, recorded in Book 152, pages 42 to 44, inclusive, Miscellaneous Maps, records of said Orange County; thence along said center line of La Palma Avenue, South 89° 14' 41" East, 1138.45 feet; thence North 0° 45' 19" East 50.00 feet to a curve concave Westerly having a radius of 1500.00 feet; thence along said curve Northerly, from a tangent which bears North 9° 56' 44" West, through an angle of 03° 54' 43" an arc distance of 102.41 feet to the Easterly line of said Lot 6 and the true point of beginning; thence continuing along said curve Northwesterly, through an angle of 15° 17' 22" an arc distance of 400.28 feet; thence tangent to said curve, North 29° 08' 49" West 362.51 feet to a line 833.52 feet North of and parallel with the South line of said South Placentia Tract No. 1; thence along said parallel line, South 89° 14' 41" East 325.67 feet to said Easterly line of Lot 6; thence along said Easterly line South 0° 14' 05" West 683.64 feet to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on Ai 2 1967 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No.pr.67_112 IQ recommending that Variance No. 1881 be granted, subject to certain conditions therein set forth and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 27th day of Junc 1967 at 7:00 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investig =tion and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not pply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting the establishment of a 156 -unit apartment complex, with waivers of the following Anaheim Municipal Code requirements or limitations: (a) Minimum distances between buildings (Section 18.28.050(7 -a)); (b) Carport location--an accessory building may abut a side property line only within the rear 25% of a building site (Section 18.28.050(6-c)); and (c) Maximum distance of dwelling units from a standard street (Section 18.28.050(9 -b)), on the property hereinbefore described, subject to the following conditions: 1. That this variance is granted subject to the completion of Reclassification Proceedings No. 66-67-65 now pending. ATTEST: 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspections. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning in- spections. 4. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked Exhibits Nos. 1 and 2; PROVIDED, HOWEVER, that the carports shall be relocated easterly to abut the east property line.
