WHEREAS, the City of Anaheim is the owner of the following described parcels of real property situated in the City of Anaheim, County of Orange, State of California, to wit PARCEL ONE Lot 5, and well site, of Tract No. 1569, in the County of Orange, State of California, as shown on a Map recorded in Look 47, page 17 of Miscellaneous kjaps, records of said County. EXCEPTING THEREFROM the Westerly 3 feet of said. Lot 5. Reserving therefrom an easement for road and public utility purposes over, under and across all that portion of said land lying easterly and southeasterly of the following described line; Beginning at the intersection of the North line cf said Lot 5 with a line that is parallel with and distant Westerly 60 feet, as measured at right angles, from the center line of Brookhurst Street, adjoining said lot on the east; thence along said parallel line, South 0° 16' 10 East, 92.83 feet to the beginning of a tangent curve, concave Northwesterly and having a radius of 15.00 feet; thence Southwesterly along said curve, through a central angle of 90° 39' 50 an arc distance of 23.73 feet to a point on the North line of Woodley Avenue, adjoining said lot on the South. EXCEPTING THEREFROM that portion conveyed to the Orange County Flood Control District by deed recorded February 10, 1961 in Book 5625, page 512 of Official Records of Orange County, California. ALSO EXCEPTING therefrom all oil, gas, minerals and other hydrocarbon substances below a depth of 500 feet, without the right of surface entry and without surface rights as reserved by Fred C. (Area of Parcel Three 957.59 square feet) AND WHEREAS, said property is not presently needed for any immediate public use nor municipal purposes and WHEREAS, the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulate& in the City of Anaheim, to wit: The Anaheim Bulletin, on May 13 and 25, 1967, a notice stating that sealed proposals would be received by the City of Anaheim at the Office of the City Clerk up to the hour of 2;00 o'clock P.Ty'1. on June 1, 1967, and would be opened in public on said date, at 2:00 P.M-, in the City Council Chambers in the City Hall by the City 21anager and City Engineer for the sale by the City of Anaheim of the real property described in said notice and hereinabove described; and WHEREAS, only one proposal was received on or before 2;00 o'clock P.M. on said date, that being on Parcel One above described, and no proposals were received on Parcels two and three; and WHEREAS, the City Council does find that the following is the highest proposal received on Parcel One of said property and that said proposal is in excess of the established minimum acceptable bid and should be accepted, upon the terms and conditions hereinafter set forth: BIDDER PARCEL NO. AMOUNT TOM DOERR One $7,781.00 No Bid Received Two None No Lid ReceiVed Three None NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the proposal of TOM DOERR, 5781 South Ohio Street, Yorba Linda, California, to purchase Parcel Number One, hereinabove described, for the sum of $7,781.00 cash, law- ful money of the United States, upon the terms and conditions hereinafter set forth, be, and the same is hereby accepted. That said proposal is accepted upon the following terms and conditions: 1. That the above-mentioned amount shall be paid to the City of Anaheim on Or before August 1, 1967. 2. That said property is sold subject to covenants, conditions, restrictions, reservations, rights, rights of way and easements of record. BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby, authorized to execute a good and suffi- cient deed conveying Parcel One of the property above described to said Tom Doerr, and to deliver said deed to said bidder upon payment to the City of Anaheim of the full purchase price for said parcel of property. BE IT FURTHER RESOLVED that Parcels Two and Three hereinbefore described be withdrawn from the market and held, pending a better financial climate.
