1967-310RESOLUTION NO. 67R -310 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 66 -67 -61 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 31st day of May 19 67 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 66 -67 -61 Beginning at the center line intersection of Ball Road and Flore Street, as shown on the map of Tract No. 1620, recorded in Book 58, pages 29 et seq. of Miscellaneous Maps, records of said County; thence Easterly along said Ball Road center line to the Southerly prolongation of the East line of said tract; thence Northerly along said prolongation and along said East line to its intersection with the center line of Vermont Avenue, 60 feet wide, as shown on said Map; thence North 74° 25' 12 East along the Easterly prolongation of last said center line to a point in the center line of West Street, 66 feet wide, as shown on said Map; thence North 15° 40' 04" West along last said center line to its intersection with the center line of South Street, 60 feet wide, as shown on the Map of Tract No. 1394 recorded in Book 54, pages 47 et seq. of said Miscellaneous Maps; thence Easterly along said South Street center line to its intersection with the survey center line of that certain State Highway commonly known as the Santa Ana Freeway; thence Southeasterly along said survey center line to its intersection with the Westerly prolongation of the Southerly line of Tract No. 3427, as said Southerly line is shown on the Map of last said tract recorded in Book 124, page 18 of said Miscellaneous Maps; thence North 74° 27' 30" East along said prolongation and along said Southerly line to the Southeasterly corner of said Tract No. 3427; thence Northerly along the Easterly line of last said tract to its intersection with the Southerly line of the Northerly 409 feet (said Northerly 409 feet being measured from the Southerly line of Vermont Avenue, 66 feet wide) of Lot 28 of Anaheim Extension, as shown on a Map made by Wm. Hamel and filed for record in the office of the Los Angeles County Recorder, a copy of which is shown in Book 3, pages 163 et seq., entitled "Los Angeles County Maps" in the office of the County Recorder of said Orange County; thence Easterly along last said Southerly line, 790.00 feet, more or less, to a point in the center line of Harbor Boulevard, formerly Palm Street, adjoining said lot on the East; thence Southerly along said Harbor Boulevard center line, as described in the deed recorded March 28, 1930 in Book 372, page 67 of Official Records, and as shown on the Map of Tract No. 1758 recorded in Book 53, pages 19 and 20 of said Miscel- laneous Maps, records of said Orange County, to its inter- section with the survey center line of said Santa Ana Freeway; thence Southeasterly along said survey center line to its intersection with the center line of Katella Avenue, as said Katella Avenue center line is shown on the Map of Tract No. 498 recorded in Book 19, page 24 of said Miscellaneous Maps; thence Westerly along last said center line, being also the North line of Section 26, Township 4 South, Range 10 West, S.B.B.& M., to the Northwest corner of said Section 26; thence Southerly along the West line of said Section, being also the East line of Section 27, Township 4 South, Range 10 West, S.B.B.& M., to the Southerly line of the North one -half of the North one -half of the Northeast quarter of said Section 27, as shown on a Map filed in Book 43, page 33 of Record of Surveys in the office of said Orange County Recorder; thence Westerly along last said Southerly line to its intersection with the Westerly line of the East one -half of the East one half of the Northeast quarter of said Section 27; thence -2- Southerly along last said Westerly line to its intersection with the Northerly line of the South half of the South half of said Northeast quarter; thence Westerly along last said Northerly line to its intersection with the Easterly line of the Southwest quarter of said Northeast quarter; thence Southerly along last said Easterly line to a point in the Southerly line of the Northeast quarter of said Section 27, said Southerly line being also the center line of Orangewood Avenue; thence Westerly along the Southerly line of said Northeast quarter to its intersection with the Westerly line of said Northeast quarter, said Westerly line being also the center line of Harbor Boulevard; thence Northerly along last said center line to its intersection with the Northerly line of the South half of the South half of the Northwest quarter of said Section 27; thence Westerly along last said Northerly line to a point in the West line of said Section 27, said West line being also the center line of West Street; thence Northerly along said West Street center line to its intersection with the Easterly pro- longation of the Northerly line of Tract No. 3204, as shown on a Map recorded in Book 97, pages 1 et seq. of said Miscellaneous Maps; thence Westerly along said last mentioned Northerly line to its intersection with the Easterly line of Tract No. 3290, as shown on a Map recorded in Book 101, pages 43 and 44 of said Miscellaneous Maps; thence Northerly along the Easterly line of said Tract No. 3290 to the North- east corner of Lot 25 of said tract; thence Westerly along the Northerly line of said Lot 25 and its westerly prolonga- tion to a point in the center line of Casa Vista Street, 60 feet wide, as shown on last said Map; thence Southerly along said last mentioned center line to its intersection with the Easterly prolongation of the Northerly line of Lot 18 of said Tract No. 3290; thence Westerly along said prolongation and along the Northerly line of Lots 18, 17, 16 and 15 to the Northwest corner of Lot 15 of last said tract, being also a point in the Westerly line of the East one half of the Northeast quarter of Section 28, Township 4 South, Range 10 West, S.B.B.& M.; thence Northerly along last said Westerly line to a point in the Northerly line of said Section 28; thence continuing Northerly along the Westerly line of the East half of the East half of Section 21, Township 4 South, Range 10 West, S.B.B.& M., to a point in the Northerly line of said Section 21, said point also being the center line intersection of Ball Road and Walnut Street as shown on the Map of said Tract No. 1620; thence Easterly along said Ball Road center line, 1321.50 feet, more or less, to the point of beginning. be excluded from R -A, AGRICULTURAL ZONE, C -1, GENERAL COMMERCIAL ZONE AND M -1, LIGHT INDUSTRIAL ZONE, and incorporated in C -R, COMMERCIAL RECREATION ZONE, upon the following conditions: 1. That dedication shall be made to the City of Anaheim on all streets within the area herein before described according to the Circulation Element of the General Plan- Highway Rights of Way, prior to the adoption of an ordinance rezoning the property. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper. THE FOREGOING RESOLUTION is approved and signed by me this 31st day of May, 1967. ATTEST: 2. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with stan- dard plans and specifications on file in the Office of the City Engineer, at the time the property is developed. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes, said amount to be paid at the time the property is developed. 4. That the owners of subject property shall pay to the City of Anaheim the sum of 15G per front foot for tree planting purposes, said amount to be paid at the time the property is developed. 5. That a preliminary title report shall be furnished the City of Anaheim, prior to the adoption of an ordinance rezoning the property, showing legal vesting of title, legal description, and contain- ing a map of the property. 6. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Super- intendent of Streets, prior to final building inspection. 7. That all air conditioning facilities shall be properly shielded from view and shall be in architectural conformance with the structure. 8. That ordinances reclassifying subject property shall be adopted as and when each parcel is ready to comply with conditions pertaining to such parcel; PROVIDED, HOWEVER, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split.
