1967-295be amended; and RESOLUTION NO. 67R -295 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 7353 IN RECLASSIFICATION PROCEEDINGS NOS. 60 -61 -96 AND 61- 62 -30. WHEREAS, the City Council did heretofore, to wit, on November 14, 1961, adopt Resolution No. 7353 in Reclassification Proceedings Nos. 60 -61 -96 and 61 -62 -30 finding and determining that the property and area therein described should be changed from R -1, ONE FAMILY RESIDENTIAL ZONE to C -1, NEIGHBORHOOD COMMERCIAL ZONE, subject to certain conditions set forth in said resolution; and WHEREAS, the owners of a portion of the property described in said resolution have requested that Conditions Nos. 4 and 7 thereof, which read as follows: 4. Dedication of 53 feet from the monumented center line of Placentia Avenue for Lots 1 to 8, both inclusive, and Parcel 10. Recordation of private ten (10) foot wide access drives between Lots Nos. 3 and 4, and Lots Nos. 5 and 6, from Placentia Avenue to the existing alley to the rear of subject Lots Nos. 1 to 8, both inclusive. Dedication of access rights to Placentia Avenue for Lots Nos. 1 to 8, both inclusive, and Parcel 10, with the ex- ception of the two ten -foot wide drives, and dedication of access rights to Underhill Avenue on Parcels 9 and 10. Further, subject to the dedica- tion by the owners of access rights to be drawn up by the private parties to run in favor of Lots Nos. 1 to 8, both inclusive, as to access to the two dedicated driveways, so that the lots on which the driveways are located will not have complete con- trol and cannot shut off the access to all except themselves. 7. All signs and advertisements located on the indi- vidual properties on Placentia Avenue and on Underhill Avenue, and visible from these two streets, shall be limited to one (1) free standing sign with a maximum of eight (8) square feet of area. The signs on all properties shall be of a uniform nature, subject to the approval of the Architectural Committee. No flags, banners, lighted signs, bill- boards, or rotating devices shall, under any circum- stances, be permitted. WHEREAS, said request for amendment was referred by the City Council to the City Planning Commission for a public hearing thereon; and WHEREAS, the City Planning Commission did hold a public hearing on said request for amendment of said Conditions Nos. 4 and 7 of Resolution No. 7353 on March 27, 1967, in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and within a period of forty days following said hearing did duly announce, by formal resolution, its findings of facts and declare its opinions and reasons for recommending that said request should be granted; and -1- 60 -61 -96 61 -62 -30 WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendations of the City Planning Commission, the City Council did fix the time and place for a public hearing on the amendment of said conditions Nos. 4 and 7 of Resolution No. 7353 and did give notice thereof in the manner and form as provided in Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the evidence presented at the public hearing before the City Planning Commission, its reports and recommendations; and WHEREAS, the City Council does find that said Resolution No. 7353 should be amended as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 7353 in Reclassification Proceedings Nos. 60 -61 -96 and 61 -62 -30 be, and the same is hereby amended as follows: (a) That Condition No. 4 of Resolution No. 7353 be, and the same is hereby amended to read: 11 4. Dedication of 53 feet from the monumented center line of State College Boulevard for Lots 1 to 8, both inclusive, and Parcel 10. Recordation of private ten -foot wide access drives between Lots 3 and 4, and Lots 5 and 6, from State College Boulevard to the exist- ing alley to the rear of said Lots 1 to 8. Dedication of access rights to State College Boulevard for Lots 1 to 8, both inclusive, with the exception of the two 10 -foot wide drives above mentioned, and for Lot 10, ex- cept for the southerly fifty feet of said lot; and dedication of access rights to Underhill Avenue on Parcel 10 and the west- erly 22.50 feet of Parcel 9. Further, sub- ject to the dedication by the owners of access rights to be drawn up by the private parties to run in favor of Lots 1 to 8, both inclusive, as to access to the two dedicated driveways, so that the owners of the lots on which the driveways are located will not have complete control and cannot shut off the access to all except themselves." (b) That in the event the existing structures on subject property are removed, Condition No. 7 of Resolution No. 7353 shall be considered deleted from said resolution, and signing shall be permitted in accor- dance with the Sign Ordinance governing the C -1, General Commercial Zone. BE IT FURTHER RESOLVED that in all other respects, except as amended herein and by Resolution No. 66R -483, said Resolution No. 7353 be, and remain in full force and effect. -2- THE FOREGOING RESOLUTION is approved and signed by me this 31st day of May, 1967.
