A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 1856
VILLA FONTAINE ENTERPRISES, INC., owner
WHEREAS, the City Pkanniik9 Commission of the City of
Anaheim did receive a petition for zoning variance from
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
That portion of the West 5 acres of the North 18
acres of the East 30 acres of the Northeast
quarter of the Northwest quarter of Section 13,
in Township 4 South, Range 11 West, in the Rancho
Los Coyotes, City of Anaheim, as said section is
shown on a map recorded in Book 51, page 11,
Miscellaneous Maps, records of said Orange County,
lying Northerly of the strip of land 75 feet in
width, conveyed to the Orange County Flood Control
District by deed recorded June 20, 1960, in Book
5293, page 146, Official Records;
EXCEPTING THEREFROM the North 66 feet thereof.
ALSO EXCEPTING THEREFROM that portion of the North
226 feet of said West 5 acres lying Easterly of the
East line of a 60 -foot strip of land, the center
line of said strip being equi distant between the
Easterly and Westerly lines of said West 5 acres;
ALSO EXCEPTING THEREFROM that portion of the North
226 feet of said West 5 acres lying Westerly of the
West line of a 60 -foot strip of land, the center line
of said strip of land being equi distant between the
Easterly and Westerly lines of said West 5 acres.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on March 13, 1967 notice of which said public
hearing was duly given as required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No, PC67 -53 Se -r- -1.e -s-
-9 recommending that Variance No. 1856 be granted,
subject to the condition therein set forth and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting the
action of the City Planning Commission �ranting said
variance, and said appeal was set for public hearing on
April 25 1967 at 7 :00 cTclock P.M. at the City
W all in the City of Anaheim, and notice of such public hearing
was duly given as required by law and the .provisions of Title 18,
Chapter 15.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:

2. That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
That the granting of such variance will not be
materially detrimental to the publi -c welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
G.. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council, of the
City of Anaheim that a conditional zoning variance be, and the same
is hereby granted permitting a waiver of the maximum area of a sign
identifying the use permitted, on the property hereinbefore described,
subject to the following conditions:
1. That the area of the sign shall be limited to a maximum
of 40 square feet.
2. That the sign shall conform, insofar as possible, to the
Anaheim Municipal Code in all aspects other than the sign
area.
3. That the sign shall be located outside of the travel por-
tion of the right of way; and that the plans, including the
shape and format of the sign, and the location thereof,
shall be subject to the approval of the Development Services
Department.
THE FOREGOING RESOLUTION is approved and signed by me
this 9th day of May, 1967.
