1967-264RESOLUTION NO. 67R -264 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO ENTER INTO ESCROW INSTRUCTIONS RELATING TO THE COMPROMISE OF CERTAIN EMINENT DOMAIN PROCEEDINGS AND TO CONCLUDE THE SAME. WHEREAS, in connection with the improvement of La Palma Avenue, the City Council heretofore authorized the bring- ing of eminent domain proceedings, and Orange County Superior Court Action No. 106614, entitled "City of Anaheim v. J. C. Coombs, et al.," was filed; and WHEREAS, the defendant, J.C. Coombs, has offered to compromise said eminent domain litigation through the exchange of certain properties and the payment of other consideration; and WHEREAS, in connection therewith escrow instructions were prepared, under and by virtue of the terms of which J. C. Coombs will deliver to the City an easement deed to the prop- erty towards which the eminent domain proceedings were directed and the City will deed to J. C. Coombs certain other surplus City property acquired in connection with the improvement of said La Palma Avenue; and WHEREAS, said escrow instructions further provide that J. C. Coombs will pay to the City the net sum of $5,155.30 and an additional sum for brokerage fee in the amount of $325.00, and the City will dismiss its eminent domain action; and WHEREAS, said deeds have been exchanged and the City is in receipt of the total sum of $5,480.30 and said escrow is ready to be closed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it authorize, and it does hereby autho- rize, the City Attorney to enter into such escrow substantially as set forth herein. BE IT FURTHER RESOLVED that the City of Anaheim accept the Easement Deed of J. C. Coombs and Mary C. Coombs, and that the City Clerk be, and she is hereby, authorized and directed to record the same; and BE IT FURTHER RESOLVED, that the Director of Finance be, and he is hereby, authorized to accept the check of said J. C. Coombs in the amount of $5,480.30 and to draw his warrant payable to Charles B. Frank Associates in the amount of $325.00 and deliver the same to the City Attorney. AND BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to dismiss that certain action in eminent domain, being Orange County Superior Court Case No. 106614, entitled, "City of Anaheim v.
