1967-256RESOLUTION NO. 67R -256 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1862. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from HUMBLE OIL COMPANY, owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of Lot 28 of Anaheim Extension as shown on a Map by Wm. Hamel, a copy of which is shown in Book 3, pages 162 to 164 inclusive of Los Angeles County Maps in the office of the County Recorder of Orange County, California, described as follows: Beginning at the intersection of the Westerly prolongation of the North line of Ball Road with the intersection of the center line of Harbor Boulevard, as described in deed to the County of Orange, recorded March 28, 1930 in Book 372, page 67 of Official Records; thence North 89° 46' 30 East along said Westerly prolongation of said North line of Ball Road, a distance of 30 feet, more or less, to the East line of said Harbor Boulevard; thence continuing along said North line of Ball Road, 150 feet; thence North, at right angles to said North line of Ball Road, to the North line of the land described in deed to Edwin Emil Kettler and wife, re- corded December 17, 1951 in Book 2264, page 590 of Official Records; thence South 89° 46' 30" West along said North line to said center line of Harbor Boulevard; thence South 11° 07' 30' West along said center line 158.48 feet to the point of beginning. Excepting any interest in the Southerly 20 feet thereof conveyed to the City of Anaheim by need dated December 3, 1953 and recorded December 11, 1953 in Book 2632, page 187 of Official Records. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on March 27, 1967, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC67 -63, deny- ing Variance No. 1862; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on May 9, 1967, at 700 o'clock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying Variance No. 1862 be, and the same is hereby sus- tained, and that the petition of Humble Oil Company for a zoning variance permitting waivers of the following Anaheim Municipal Code re- quirements or limitations: (1) The maximum number of Free- Standing Signs (Section 18.62.090- E(1)); (2) Maximum height of a Free- Standing Sign (Section 18.62.090- B(2)); (3) Maximum area of a Free- Standing Sign (Section 18.62.090- B(4)); and (4) Location of a Free Standing Sign in relation to the property line of an abutting parcel of property (Section 18.62.090- B(5)), on the property hereinbefore described, be, and the sane is hereby denied. THE FOREGOING RESOLUTION is approved and signed by me this 9th day of iay, 1967.
