A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF AN AGREEMENT BETWEEN THE
CITY OF ANAHEIM AND THE COUNTY OF ORANGE,
WITH REFERENCE TO THE IMPROVEMENT OF LA
PALMA AVENUE, BETWEEN FEE ANA STREET AND
IMPERIAL HIGHWAY.
WHEREAS, the County of Orange is proposing to construct
roadway improvements on La Palma Avenue between Fee Ana Street
and Imperial Highway; and
WHEREAS, portions of the proposed improvement are in
the City of Anaheim; and
WHEREAS, the County and the City consider it in the
best interests of economics and public safety to combine the
improvement in their respective jurisdictions into one project;
and
WHEREAS, the County has offered to design, contract,
and inspect the City portions of the project, and has tendered
to the City a form of agreement to be entered into between the
parties providing for the inclusion of the City's portion of
said improvements in the County's construction project on La
Palma Avenue; and
WHEREAS, the City Council finds that the terms and
conditions of said agreement are satisfactory, and that said
agreement should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement tendered to the City by
the County of Orange, to be made and entered into between the
parties, providing for the inclusion of the City's portion of
the improvements on La Palma Avenue, between Fee Ana Street and
Imperial Highway, in the County's project, to which reference
has been made, upon the terms and conditions hereinafter set
forth, be and the same is hereby approved. Said terms and
conditions are as follows:
1. The County shall:
a. Be designated as Project Engineer, Contracting
and Construction Agent for the parties to do
and perform all things necessary in order to
construct the proposed improvement of La
Palma Avenue between Fee Ana Street and Imperial
Highway, including the acquisition of right of
way within the City, and to execute and deliver
all documents required in connection with the
construction and completion of said project,
including Certificate of Cost and Certificate
of Completion of the project.
b. During the period of construction have juris-
diction over the construction area including
that portion of the project within City area.

c. Finance right of way acquisition costs for all
County right of way including the Warner
Lambert Parcel No. 136.01 as colored in red on
Exhibit "A" attached to the agreement tendered
to the City, which shall be acquired by the City.
2. City Shall:
a. Approve the plans and specifications as they
pertain to construction and maintenance features
for City portions of the project.
b. Be designated as right of way agent for the
County in order to acquire the Warner- Lambert
Parcel No. 136.01 as shown on said Exhibit "A."
c. At all time during the progress of construction
of said project have access to the work thereon
for the purpose of inspection thereof, and should
the City deem any remedial measures to be neces-
sary, the City shall notify the County thereof.
d. Finance all right of way and construction costs
for work done within the City.
e. Upon completion of the acquisition of said
Parcel No. 136.01 submit to the County all
applicable right of way acquisition charges in
order that they may be considered in the final
billing for the project as outlined below in
Section 5.
3. The total estimated City Cost is presently $45,000.00,
which sum includes an estimate of the engineering and
overhead for the City portion, including right of way
acquisition costs.
4. The City's share of the right of way and construction
costs shall be determined on the basis of the amount
of right of way acquired and construction work done
on said portion of roadway lying within its boundaries,
as these boundaries exist at the time of advertising
the project.
5. Upon completion of construction of said portion of
pavement, the County shall submit full, true and
correct copies of documents, certificates and
itemized bills to the City and the City shall
reimburse the County within thirty (30) days upon
submission of such costs. Such bills shall be based
on the actual right of way acquisition costs and the
actual quantities of construction and the unit prices
bid for the contract; and shall also contain a
charge for engineering and inspection based on the
proportion of contract cost for the portion within
the City to the total contract cost and the total
engineering and inspection costs, plus a charge for
overhead on the engineering and inspection performed
by the County, and exclusive of administrative over-
head.

BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
