A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING A PETITION FOR
REMOVAL OF DEED RESTRICTIONS FROM THE
PROPERTY HEREINAFTER DESCRIBED; AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
SIGN A CONSENT TO THE REMOVAL OF SAID
RESTRICTIONS.
WHEREAS, the City Council did heretofore, to wit, on
October 27, 1959, adopt Resolution No. 5567 in Reclassification
Proceedings No. 59 -60 -14 finding and determining that the prop-
erty and area therein described should be changed from R -A,
RESIDENTIAL- AGRICULTURAL ZONE to R -1, ONE FAMILY RESIDENTIAL
ZONE and C -1, NEIGHBORHOOD COMMERCIAL ZONE, as more particularly
set forth in said resolution, subject to certain conditions
enumerated therein; and

WHEREAS, one of said conditions precedent to said
change of zones, being Condition No. 1 of Resolution No. 5567,
provided that standard City of Anaheim C -1 Deed Restrictions be
placed of record limiting the uses of the C -1 property to busi-
ness and professional offices only, and said restrictions were
duly recorded in Official Records of Orange County, California
on September 2, 1960, in Book 5402, Pages 250, 251 and 252,
Document No. 154816; and
WHEREAS, the owner of the hereinafter described portion
of said C -1 property on which said City of Anaheim deed restric-
tions were recorded, has petitioned the City Planning Commission
for removal of said restrictions from that certain portion here-
inafter described, in order to permit the establishment of a
walk -up restaurant thereon; and
WHEREAS, the City Planning Commission did on
February 27, 1967 hold a public hearing on said petition after
having giving due notice thereof in the manner and as prescribed
by law, and did, within a period of 40 days following said hear-
ing, adopt Resolution No. PC67 -48 recommending to the City
Council that said deed restrictions be removed from the herein-
after described property; and
WHEREAS, upon receipt of the report and recommendation
of the City Planning Commission the City Council did thereupon
fix the 28th day of March, 1967 as the time and the Council
Chambers in the City Hall of the City of Anaheim as the place
for a public hearing on said petition for removal of said deed
restrictions, and did give due notice thereof in the manner and
as provided in Title 18 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and

WHEREAS, the City Council does find that said request
should be granted and that the consent of the City of Anaheim
to the removal of said C -1 Deed Restrictions from the property
hereinafter described should be given.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the petition for removal of said
standard City of Anaheim C -1 Deed Restrictions, recorded on
September 2, 1960, in Book 5402, pages 250, 251 and 252,
Document No. 154816, Official Records of Orange County, Cali-
fornia, from that certain real property situated in the City
of Anaheim, County of Orange, State of California, described
as:
be, and the same is hereby granted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to sign the consent to re-
moval of said restrictions for and on behalf of the City of
Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 28th day of March, 1967.

Beginning at a point 40.392 chains South and 30 feet
West of the Northeast corner of said Section 17;
thence West 9.565 chains; thence South 6.27 chains;
thence East 9.56 chains; thence North 6.27 chains to
the point of beginning.
EXCEPTING THEREFROM that portion lying Westerly of a
line that is parallel with and 203.00 feet Westerly
measured at right angles, from the East line of said
Section 17.
