1967-163RESOLUTION NO. 67R 163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1849 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from DICK H. ABLES and EUNICE M. ABLES, owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of Lot 4 in Block 12 of "Subdivision of the South half of Section 21, Township 4 South, Range 10 West, San Bernardino Base and Meridian" being part of the Fair- view Colony Tract, in the City of Anaheim, as shown on a map thereof recorded in Book 1, page 33, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the intersection of the North line of Lot 4 in said Block 12 extended Westerly with the center line of Garden Grove Road (now Euclid Avenue) as shown on said map; thence Easterly along said Westerly extension and the said North line of said Lot 4, 210.00 feet; thence South parallel with the center line of Garden Grove Road, 162.00 feet; thence West parallel to the North line of Lot 4 and its Westerly extension 210.00 feet to a point in the center line of Garden Grove Road; thence along said center line 162.00 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 30 19 67 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC67 26, denying Variance No. 1849 and -1- WHEREAS, thereafter within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance and did set a public hearing thereon to be held on the 14th day of M rch 19 67 at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Variance No. 1849 be, and the same is hereby sustained, and that the petition of Dick H. Ables and Eunice M. Abies for a zoning variance to permit the establishment of a convenience food market, on the property hereinbefore described, be, and the same is hereby denied. THE FOREGOING RESOLUTION is approved and signed by me this 28th day of March, 1967. ATTEST: WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2.
