1968-133WHEREAS, public convenience and necessity require the
acquisition of certain real property within the City of Anaheim
for the following purposes, to wit: highway easement and public
utility purposes; and
WHEREAS, the City Council does find and determine that
public interest and necessity require the acquisition of all
that real property herein described, by the City of Anaheim for
highway easement and public utility purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that public interest and necessity require
the acquisition of the following described real property, to
wit:
All that certain real property situated in the City
of Anaheim, County of Orange, State of California,
more particularly described as follows, to wit:
PARCEL 1:
An easement for road and public utility purposes over,
under and across the Easterly 30 feet, as measured at
right angles to the center line of Dale Avenue, of the
South 82.50 feet of the North 247.50 feet of the East
264.00 feet of the Northeast quarter of the Southwest
quarter of Section 12, Township 4 South, Range 11 West,
in the Rancho Los Coyotes, as shown upon map made by
Charles T. Healey upon survey by him about 1870 for
the Stearns Ranchos Company.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DETERMINING THE NECESSITY
FOR, AND DIRECTING THE ACQUISITION, BY

Beginning at a point in the East line of the Northeast
quarter of the Southwest quarter of said Section 12,
said point being distant North 0° 11' 30" West 851.27
feet from the Southeast corner of the Northeast quarter
of the Southwest quarter of said Section 12; thence
North 0° 11' 30" West, along said East line, 82.50
feet; thence South 89° 40' 30" West, parallel to the

Southeast corner of the Northeast quarter of the

Beginning at a point in the East line of the Northeast
quarter of the Southwest quarter of said Section 12,
distant North 0° 11' 30" West 491.27 feet from the
Southeast corner of the Northeast quarter of the
Southwest quarter of said Section 12, running thence
North 0° 11' 30" West along said East line, 86.665
feet; thence South 89° 40' 30" West parallel to the
South line of the Northeast quarter of the Southwest
quarter of said Section 12, a distance of 264 feet;
thence South 0° 11' 30" East, 86.665 feet; thence
North 89° 40' 30" East parallel to said South line,
264.00 feet to the point of beginning.
BE IT FURTHER RESOLVED that the City Council find,
and it does hereby find and determine, that public interest
and necessity require the acquisition of said property by the
City of Anaheim for the aforesaid purposes, and that the taking
of the property hereinabove described is necessary therefor,
and that the uses to which it is to be put are uses authorized
by law, and the taking of said property is necessary to such
uses.
AND BE IT FURTHER RESOLVED that the City Council does
hereby authorize the acquisition of said property by the City
of Anaheim, and the City Attorney of the City of Anaheim is
hereby directed to institute an action in eminent domain for the
acquisition of the title to said property, and to perform and
carry out all of the necessary proceedings and steps incident to
the acquisition of the title to said property and to obtaining
immediate possession thereof.
